pyrnad, Bad Neighbor Update

    For those of you who have been sending me pm's, here is an update.
    My neighbors had another survey done, and guess what? It matched the one I had done :dance: Go figure.
    My lawyer is very angry as they hired a lawyer, and their lawyer did not inform my lawyer of them doing another survey. :grump:
    My lawyer was on vacation last week. When we spoke on monday I informed him about the new survey.
    He phoned their lawyer. They now have 30 days to remove the leech field from my property :dance:
    I guess it is going to get real interesting as they turned down my offer, and now want to know if I would be open to onother offer?
    I can not wait to see what the offer is?

    Thanks for the update. Hope the leech field removal does NOT leave a mess/hole on your property. Surely your lawyer would have covered returning the land to it's original condition?

    I hope you get whats fair, and just, but i also hope your neighbors do as well.

    BTW i saw that ms murphy just lost her appeal a week or two ago. But it also appears she has been writing letters to all the branches of government, and quite a few magazines.

    I think this story has about beat itself to death ..nothing new ..story still completely one-sided and we know what to expect before we even read it. Nothing new ..no compromise ..no compassion ..the neighbor is still 'reportedly' bad ..just as the title of the thread says.

    However ..if any of us were in the neighbor's shoes with the leech field situation ..we'd all be highly upset. FWIW, the neighbors most likely have some type of options they could pursue ..that will relieve them of the financial liability for the leech field. After all ..these neighbors did not install that leech field on Pyrnad's property. Same as most of you would likely do ..if I were the neighbor ..my lawyer would be finding out who is ultimately liable for the expense involved. But ..that's just me.

    If I had them as neighbors ..I'd probably help the neighbor somehow. But again ..that's just me.

    Furthermore I'm rooting for the neighbor for everything except the trees ..but still again ..that's just me.

    Well for my record if they aint smart enough to bark up the right tree TFB for them. She tried the nice route more than once....giddyup!

    This is why most lending institutions require that you purchase mortgage insurance when getting a home loan. If I were the neighbor, I'd determine whether or not I had purchased a mortgage insurance policy when I bought the property.

    Thanks for the update Pyrnad. I've been wondering how things are going. I hope this all over soon and you can get back to quiet, peaceful life on the farm. Hang in there. :)

    I know you're probably not comfortable posting actual dollar amounts, but I'd love to know what they paid for it and what they wind up getting for it. Buyer beware and all that.

    Err, so they have 30 days to :

    "remove their leech field from your property"
    or
    "remove your leech field from your property"

    cause only the first one makes sense, but it cant be theirs if they didnt buy it.

    so i guess you mean they have 30 days to quit using your leech field, but
    then whats all the talk about remove it ? You want them to quit using
    your leech field and then dig up your leech field and pay to haul it off and
    bring in fresh dirt ? Makes no sense to me.

    If I remember correctly, P. said they paid cash for it and did not have any inspections done so I would be doubtful they got title insurance or even had a title search done. Dumb, dumb, dumb, but I guess that's what happens when you think you're smarter than everyone else.

    Thanks for the update, Pyrnad. Wouldn't you have loved to have seen their faces when they got their survey results.
