She was going to quit her Full Time,take Layoff from her Part Time Job,Draw Unemployment and go to school.

She told me today she is going to stay with both Jobs.Because the way the Goverment is doing things there is not going to be any Unemployment plus Paying for Schooling.

dh is laid off for 2 months now. It varies from state to state what the benefits are. he can draw for 26 months.....if he comes up with a written plan though and takes it in and they approve it, they will pay for him to go to school for 2 years and he will still draw unemployment. We just can't make it for two years on unemployment. He can't make it for two years without working either. Two months has been more than enough for him I think.

Up here you don't get unemployment if you're fired. And Vermont is a fire at will state... basically the company either has to agree to lay you off and NOT FILL YOUR POSITION or it has to be actually folding, and you're part of a bulk layoff.

But you won't get unemployment if you're fired... and you won't get it if they immediately fill your position. The position has to go away. Or at least that's the letter of the law. I'm sure there are dainty ways to work around the law, but that's the wording and spirit.

You CAN collect unemployment if you quit. The reason has to be legitimate, though. For instance, if you work in a nursing home and they want you to do unethical things like restraining patients or some such. It has to be something that will threaten your ability to perform in a legal or ethical manner. It is very difficult to collect if you are fired, as the company can refuse the unemployment for the reasons they fired you to start with.

My friend got fired from a granite counter top cutting company he was working with. The boss said he "messed up" around 8 tables worth of orders but he had already stated the machine needed to be re calibrated but the floor manager just said "do it". When he went to collect unemployment they tried to deny it but he just brought up the fact that he had told them about the defect and they fired him for messing up something that didn't need to be messed up in the first place. Without even going to a lawyer, he easily got the grant for unemployment. Quitting on your own however, unless you have a good reason, will likely net you zero.

What did she want to go to school for? What area of study I mean?

you might also inform Nancy that you don't get unemployment if you QUIT your job -only if you get laid off or fired and then you only get unemployment benefits for a set amount of time***. :nono: In this ecomony, if a person HAS a job, they'd do well to keep it. Time to stop relying on the Government for anything - too many folks have gone to that well too often and its a dry hole.
*** editted to add: Check your state's unemployment laws and websites - things do vary from state to state.
She done checked in to it.If she quits this Full Time Job and gets Laid off on her Part Time Job,if her Job she quits refuses they have to pay her as much as her Part Time Job which they won't.

Plus the way they have it set up they will Pay Unemployment until it runs out then goes into TRA while she is going to school.

She is just having second thoughts because she says she don't see how the Goverment can keep paying the way things are going.

At the very least she needs to check on when re-education money is available. I lost my job due to company closing in July of 07 and there was no education money left anywhere for the current year. I was a single parent and sole support of a minor with unemployment earnings well under the poverty level so I would have been eligible for many educational grants had there been funds.
