I have a delema.

It seems that someone has moved a property line on my land. I was up on top of my land today and there was a stake saying proposed well site. it was about 30 to 40 feet on my land. as I proceeded to the corner bounds of the property I noticed a new corner had been established, about 30 to 40 feet on my land. I have emailed my attorney. this may be a sand event for me. I am so upset I could spit. People are so corrupt. they will steal anything if they can.

Have your attorney tell the people who moved the corners that they have to pay for a survey by a surveyor approved by you that shows the new corners or they'd better move the corners back where they belong.

did the neighbor have his land surveyed and thins looked different and moved the stakes. You should have title insurance when you bought the property. Don't get up crazy ...things work out and even if someone moved the property line...you can legally move it back..But, makes me wonder why someone would want 30 feet more..tax reason or something ?? It will et straightedn out..Take a deep breath and keep us up on the the results. Good Luck..

They want to drill a oil well on my land. Thanks for the calming words. I am upset but I am not going to something till I cant get any legal satisfaction. Big oil has a million lawyers and I cant even afford one.

When I went up there, there was a stake in the middle of were I mow the grass. and the ribbons that were marking my property lines done by the oil company when they bought an acre a few years back have been removed. And the Blaze that marks the corner has been relocated to another tree. I don't think it is a mistake.

Bite the bullet, pay for your own survey, built a fence.

OK, if no title insurance, you will have to do as TnAndy suggests and get a professional survey and title search. The reason for the title search is to find out any conflicting claims. You'll be spending a few bucks, be prepared for sticker shock.

Did the oil company set the stakes? If so, that's a different issue. The state may have records of the original survey for the well if they got a permit.

Normally if a surveyor is checking a boundary line they alert adjacent landowners. Your situation sounds different. I don;t think a surveyor for an oil company has to do that.

Might be a good time to contact the surface owners association. Which county are you in? PM me if you want to keep that private.

That would be upsetting! I agree that the best thing to do is have it surveyed. Your attorney should also let the oil company know not to do anything further while you are having the survey done and the title searched.

Go to your surveyor and ask him how he screw up. In most survayers will have a record of their surveyed land. Most will keep it and be ready to go to court in that case.

Did you or your surveyor register your survey? If you have a registered survey, there should be a procedure that has to be followed to change the line. Check with the county.

It looks like it has been surveyed. I have the original survey and all the oil company's have there own survey crews. who knows they can just move the lines wherever they want. I wan never notified by any one. they just took my land like I am a pos. I have to stop now as I am getting mad. Will post more after I talk to my lawyer. Thanks everyone for your help.
