Man charged for videotaping sheriff's deputies
"Andrew Henderson watched as Ramsey County sheriff's deputies frisked a bloody-faced man outside his Little Canada apartment building. Paramedics then loaded the man, a stranger to Henderson, into an ambulance.
Henderson, 28, took out his small handheld video camera and began recording. It's something he does regularly with law enforcement.
But what happened next was different. The deputy, Jacqueline Muellner, approached him and snatched the camera from his hand, Henderson said. "We'll just take this for evidence," Muellner said. Their voices were recorded on Henderson's cellphone as they spoke, and Henderson provided a copy of the audio file to the Pioneer Press. "If I end up on YouTube, I'm gonna be upset."

So the cop stole the camera, and tried to cover her tracks by making the excuse that the camera was evidence.
The fourth amendment of the U.S. Constitution requires a warrant for such a action. Not hard to understand just read the document.
So the evidence (if it ever was) is tainted because the cop broke the law to get it. Just another waste of taxpayer dollars.
So what's new.

There are an astounding number of videos on youtube of police officers harassing and sometimes arresting people who were video taping them. It's ridiculous that most of them get away with behaving so badly when there is video evidence of their behavior.

When they started to put a tape machine in the car everybody was told that they might be taped and act according to it. Just because he was videotaped can make it evidence but grasping the camera was wrong what she should have done is either get a tape or a copy of the tape if in digital form. the police around here are used to being taped all the time and it doesn't matter to them.

Sorry, the supreme court ruled the 4th amendment obsolete last year! No warrant neccessary anymore!

Jeffrey,
I wondered about that. Have the courts ruled/decided that "we" can be video taped in public by random cameras and police dash cameras and we can record other people in public venues with video equipment but we cannot legally record the police performing their duties in public? Anyone know the answer?

I know that in some area's the local courts have ruled that police can be video taped and some area's say you can't because it's an impediment to their job! If they can record, so can we. If their afraid of being recorded, their probably breaking the law themselves and don't want it caught on tape! What's the difference if someone has a camera, or one is attached to a building recording the same stuff? Can the cop arrest the building owner? Seize the tape/ hard drive? Cops are NOT above the law and they are also citizens, not some elite group. Public servants!

I should have added in the interest of full disclosure, I wear a badge for a living......
I also treat every contact as though I am being recorded and a copy of the contact will be sent up my chain of command. Personally, I believe it keeps me professional in the face of the occasional "unpleasantness".....carry on.

Didn't mean to scare everyone off LOL. As long as you extinguish your campfire and keep your dog on a leash in the campground about the only thing you will see from me is a friendly smile and wave as I drive by....

I am a Chief Park Ranger for the U.S. Army Corps of Engineers. We primarily enforce Federal regulations and leave the State and Local law enforcement to those agencies. In prior service I was a Deputy Sheriff. To directly answer your question, no I would not enter/search/seize without a valid signed search warrant. Further, I have never heard of or worked for a supervisor that would ask an officer to do that.

Thanks. Good to hear that! I know a few here that would and have. I live in So. Kalifornia, so the police feel and state constantly that they are above the people their working for. They call us "citizens"! (one shot herself while entering an apartment without a warrant, then tried to sue the renters because they had a gun in the apartment. Smart judge thru out the claim)

Sadly there is no shortage of those types. Despite a fairly rigorous investigation/review there are too many that squeak through.
As for what I call you, it is usually either verbally expressed as "sir" or "ma'am" but it is always internalized as "boss". I live by that creed and insist all those under me do the same. I like to use the comparison that we've all worked for a difficult boss and this punk/scumbag just happens to be the boss you're working for at this moment in time......write the paper, do your job, be professional and save the grin/smirk til you're out of view.....

I wanted to add that i do know some who are a credit to their communitees. They are the kind that i grew up with and a real credit to their agencies. The new breed we have here came from the jails and have that jail mentality. I also use "sir", "ma'am", until it's time to NOT use those terms.

I always thought Pres. Obama would put the last nail in the coffin.
I certainly don't think he built the coffin, put all the others nails in, however.
By thinking he did it all, if we squeak through, we will, once again, vote for another Republican just like the last one that hammered in quite a few of those nails.
