Federal judge orders Osceola County sheriff to issue gun permit

IMGHAR, Iowa -- U.S. District Court Judge Mark W. Bennett has ordered Osceola County Sheriff Douglas L. Weber to issue a gun permit to a resident and to complete a college-level course involving the First Amendment.

Bennett’s written decision on Wednesday involves the case of Paul Dorr, of Ocheyedan, who was denied a permit to carry a concealed weapon.

Dorr and his son, Alexander, were denied gun permits after being engaged in extensive First Amendment activity -- protesting, passing out leaflets and writing letters to the editor -- the opinion notes.

“The court finds a tsunami, a maelstrom, an avalanche, of direct, uncontroverted evidence in Sheriff Weber’s own testimony to conclude beyond all doubt that he unquestionably violated the First Amendment rights of at least Paul Dorr,” Bennett wrote in his ruling.

Very unusual. A judge that knows the constitution exists. Congratulations judge Bennett.

A BC case?

The sheriff in this case lives in my town. This has been big news around here long before the judge decided. The man denied the permit is a survivalist, but as far as I know is no threat to society. He is extremely politically outspoken and has stepped on a few toes. Hence the reason for denial of permit. That being said, I think it's awesome that the sheriff has to take a class. Also the man denied the permit is brother to: Thomas C. Dorr

Birth Certificate case, the one that Obama dosen't have.

MN had a problem with some sheriffs refusing to grant CC permits to anyone even people with restraining orders against their spouse. The legislature took their discretion away and now requires them to issue permits to people who qualify.

This state gives too much discretion to authorities and they abuse it.
