Geese and ducks illegal here...

My friend just got slammed at a local swap for having geese and ducks. They said, we are only allowed to have pekin ducks, and muscovies. All others will be fined, or put down if you don't have a permit. I guess, this is a new law...here in Florida. Also, we can only sell them to people who have a permit, and all records must be kept.

I don't think it's anything new. They probably were just not enforcing it

No person may take, possess, import, export, transport, sell, purchase, barter, or offer for sale, purchase, or barter, any migratory bird, or the parts, nests, or eggs of such bird except as may be permitted under the terms of a valid permit issued pursuant to the provisions of this part and part 13 of this chapter, or as permitted by regulations in this part, or part 20 of this subchapter (the hunting regulations), or part 92 of subchapter G of this chapter (the Alaska subsistence harvest regulations). Birds taken or possessed under this part in “included areas” of Alaska as defined in §92.5(a) are subject to this part and not to part 92 of subchapter G of this chapter.

I'm sure you can have more than just pekin ducks, and muscovies but there is a lot that you are supposed to have permits to own.

Bearfoot:
This sounds unreasonable. All states and the Feds have regs restricting the taking, killing or breeding of migratory waterfowl, songbirds, raptors, etc, but none that I know of prohibits the keeping of recognized varieties of domestic animals. What reason would they have for prohibiting the keeping of a Toulouse goose or a Rouen duck?

There might be regulations concerning health issues perhaps?????

Other than Muscovies, all breeds of domestic ducks are the same species (mallard).

I think that the officer was a little confused. The website only lists "ducks" and "geese" without specifying breeds.

Supposedly, it's every breed of ducks and geese, other than Pekins and muscovies.
I guess all others are considered wild life?

Most of the domestic ducks are exactly like Pekins, how can Pekins be ok and the others not?

Most Pekins are white, while many other breeds look very similar to wild species.

Exactly which species of ducks does this rule cover, since most domestic ducks are derived from mallards?

Provision (1) of the rule states:
"For the purposes of this section, "mallard" includes all Anas platyrhynchos and fertile hybrids thereof except the white variety of Anas platyrhynchos commonly known as "Pekin" ducks."
Most domestic ducks are members of Anas platyrhynchos domesticus, so all provisions of this rule apply. However, this rule does not apply to Pekin ducks, muscovy ducks (Cairina moschata), or any other species that is not Anas platyrhynchos. Check with the seller or breeder before purchasing any variety of domestic duck.

2) License to Possess Wildlife for Exhibition or Public Sale
Annual permit for Class III wildlife is $50 for an unlimited number of animals.
