I'm here Backfourty-just barely

Minelson is right, I really need some prayers. I appreciate you thinking of me.

Without making it sound like "poor me", here is a rundown on why I need prayers. My dad is living with me now to rehab from a hip fracture and surgery. His little hot dog of a dog was almost killed by my GSD. We think it was bitch to bitch aggression because the little one would often snap and growl when my dog came near my dad and Baylah finally just had enough. It was a total blood bath and still gives me nightmares. The fight was so bad that it took me four tries to finally keep a hold of her and stop the attack. Now me dad hates my dog and the little one is staying with my mom.

I am in foreclosure and have been trying to get a moritorium but probably wont qualify. I need about $3000.00 to get out of it and that just ain't gonna happen. I have been trying to sell my goats(most of them) but the market stinks for registered animals.

My son and I are having issues. He is 23 and moved back home to help me out but he is regretting it now and is very unhappy. He has his own apartment in the basement so he does have his own space. Our relationship is very fragile right now.

And to top it all off, I couldn't get my chemo infusion this past Thursday because my hematocrit and hemoglobin are too low--just about low enough for a transfusion. So apparantly I am bleeding from somewhere internally, have gone into bone marrow failure, or have hemolysis(?) which is when your body makes red blood cells and destroys them immediately afterward. So I am in a lupus flare now and in so much pain and am soooo fatigued that I can barely function and unless I go way up on the steroids, I will feel this way until I get chemo again. Fun huh?

Yup, things are a little funky right now. I know the Lord is there and that there is not even a sparrow that falls that He doesn't know about, but boy am I pooped. Please pray that His will be done and that it works out the best way possible for everyone. Thanks in advance and I really do miss coming on here all the time. But I cant leave my dad home alone and can only access the internet at a public rec center.

Your sweet Shazza, thanks. Unfortunately, I look after myself. My house shows it too. What a disaster area. It's embarrassing to have people come over and see what a disgusting mess it is, but I have trouble breathing just walking from one room to another, never mind cleaning. And that is with O2!

CrazyGoatGal, I have gone through similar things, caring for a husband with dementia while undergoing chemotherapy and then radiation. That was two years ago and, looking back, I'm not sure how I made it through, but I did, and you will too. They say the Lord will only give you what you can handle, but I remember thinking at the time that He has a lot more confidence in me than I did. Hang in there, you will get through this. I will pray for you.

There is a way to stop foreclosure-

You can file a document with the courts, and also send registered letters, return receipt requested, keeping all copies of everything, to the mortgage company stating that they MUST provide you with a copy of the original mortgage note with your original signature on the note before they can proceed any further.

The reason for this is that banks and mortgage companies frequently sell mortgages to each other WITHOUT NOTIFYING YOU! Your mortgage note may have passed through a half dozen hands by now.

THIS IS ILLEGAL! You have the right to be notified with each and every transaction made concerning your property. State that you never received any notification whatsoever of the note changing hands.

The chances are they the original note has been destroyed, therefore, they cannot provide you with what they do not have.

*If they cannot provide you with the original document, with your original signature, THERE IS NO FORECLOSURE!*

CrazyGoatGal - I have nothing to offer but to say that we will remember yo in our prayers. It certainly sounds like you need a lot of help.

If I can ask without being rude - why has your dad come to your's to rehab after his fracture if you are ill?

I am sending BIG HUGS and many thoughts & Prayers your way. You sure have alot on your plate but I know your going to come through it.
I just noticed I hadn't seen you here lately & knew you were not the best of health & so I thought we should check on you.

I think you should try to do what betsyh said about the mortgage company. They also have what is called a LOAN MODIFICATION thing going right now so they can lower your interest rate & refinance your house for you, etc. You should really call your lender & explain things & see if there isn't something they can do to help you keep your house.
I know they don't want to take people's houses from them.

What Betsy suggeted will buy you time but not alot. It does not do anything but give you time to try to find some money. No matter if they find your documents or not you will still owe it no matter what.
The real way to save your house is to call your mortgage company's Loss Mitigation Dept. Start with them and tell them that you can pay your mortgage and want to save your house but have fallen behind due to health issues and cannot catch up. Some mortgage companies like Chase have set up a Loan Modification Dept. I went through this when the IRS kept screwing up and garnishing most of my husband's paycheck even though we are on an automatic payment plan!!
Anyway the modification dept wanted a heartship letter, the past few bank statments and things like that. They gave us a new loan without any fees, a better fixed interest rate and even rolled in an extra payment so we would have some extra money. They really were good about it.
I have heard that Countrywide is the worst company to deal with, but since they were bought out by another bank it is getting better.

I am not going to get into a big argument, but " Show me the documents" will NOT save anyone's house. It is just a delaying tatic used by people to stay in their homes, some seem to think it is a free ride for a while.
A woman in FL is using this and she is sitting in her house in the dark without any electricity and cannot afford her home or catch up on her payments. She is not going to win because as soon as it gets in front of a judge she will have to pay or get out. No one is going to get their house for free using this method, they will just delay it. I have read quite a few articles about it and it buys you a few months not forever.
Plus it never pays off what you have been not paying. So if you get 6 more months out of your house while waiting for your court date, plus you were 2 months behind you now owe 8 back payments plus late fees and they will toss you out soon after the judge rules in their favor.
I could not find that man's blog just a bunch of nutty survival stuff when I searched for it. But again he is putting off the inevitable. He should just call the mortgage company and work it out. They really do not want your homes as they cannot sell them and would much rather work with you and keep you in your house paying for it. Many mortgage companies have set up ways to help you stay in your house.
Either way in the end you will pay, wether by being foreclosed upon and having ruined credit and no place to go or by actually paying for your house and staying in it.
I have been through this and if you want to pay the debt you actually owe and stay in your house then going through Loss Mit, who refer you to the loan mods is the right way to go.

There's a lot more to it than that- and courts are siding with the home owners.

The key, of course, is to turn away from the credit based society back to the way it was before the banks took over our lives.

Besides, different states, different situations, and one wins by being pro-active, not reactive. Turn their rules and ways of doing business back on them- that's what they do not expect.

Good luck, I believe you can do it! Do not be afraid to fight fire with fire though.....you are a LOT stronger than you may think.
