Update on breach of contract

I'm so upset right now... tonight we had to go and repossess the mare that we sold back in May. The Chief of Police assisted us as we found and loaded the horse. She's back here now and I'm waiting (anxiously) for the fight to begin. You see, the buyer was not at home (or would not answer the door) when we went to get her.

I wish things could have ended differently but the buyer has not made a single payment since she took possession! Since all of this has begun, I have learned that the buyer has been charged with theft by deception and bad checks in several neighboring counties, and is facing criminal charges. What a crazy mess!

My heart does go out to the buyer's kids though. The thought of them waking up tomorrow and finding the horse gone makes me very sad.

You may not have a fight at all.... here's hoping that the lousy buyer just hides and never bothers you again.

thanks. I'm hoping too... but it does seem to me that those who are on the wrong side of the law tend to look even harder for the loopholes.

Oh! I'm so sorry! At least you had police to be helpful and let you go get the mare! I feel sorry for the kids, but a woman like that probably wouldn't provide the horse good care in the long run, and the kids need to learn that cheating people doesn't work to one's advantage.

Sorry to hear that you had to take the horse back, but you did the right thing! Imagine how soon it would be that your poor horse would be going without food at the hands of someone who is known for stealing and cheating. Seems like only a matter of time before she didn't have the means to legally pay to feed the horse.

I do feel bad for their kids, but I'm really relieved she is home with you.

We (DH and I) went with a dear friend a few years ago to help her repossess a horse. My friend had leased out the mare, but got a tip that she was being neglected.

When we got there the poor little thing was thin as a rail and covered in rain rot, locked in a tiny paddock with no food or water while all the other horses were fat and happy out in the field.

In retrospect we should have called the police before going in, but we didn't. DH had to take down the fence to get her out, while he was doing so, the woman's partner showed up and started screaming profanities at us, but it was the 3 of us against her.

My friend and I loaded the horse in my trailer, while DH put the fence back exactly as it was. We hauled out with the lady screaming about calling the cops.

A few minutes later while we were still on the road my friend got a call on her cell, it was a police officer..

"Maam, did you take the horse?"

"Yes officer she's my horse"

"Do you have the paperwork to prove it?"

"Yes I do"

"ok, no problem then, have a good day Maam"

Wow... what a story Tiempo! I'm so glad I had the local police on my side. Still, I kept waiting all day Sunday for the State Police to show up. They never did

But are you ready for the latest development? I have since found out that the owners were definately not at home when we took the horse... because they were in JAIL.

Their relatives came up the next day to move the horses to another farm. It's a darn good thing I got her when I did or I would have never found her!

Good grief! What a tale you will have to tell for years to come.

I am glad you went and got her back. In truth, I had been thinking of you, her and your post off and on since you first posted it. So glad she is back where she can be taken care of.
