kygardengal, just a suggestion, whether you have the sheriff or not, please take a male(preferably a large one) with you when you tell him to move his shed. I know that sounds sexist as all get out and believe me I find it distasteful but I've been where you're at and I think I can speak from experience.

Depending on his mindset; he may think that since he's male he will have the 'final say' and listening to a woman isn't something he's willing to do. In fact that could be why your other neighbor said to get the sherrif.

Also, again depending on his mindset, you should have a witness as well as someone there with you just in case he's more prone to violence when confronted than you are expecting.

That's where my experience comes in; same situation with the boundary line, he cuts my fences and pulls the corner pin, I ask nicely for him to put the fence back up, nothing, I get surveyor out to repin, tell neighbor in a respectful but firm way that I will be refencing and then have him pull a gun on me!!! I was alone at the time.
So, in the end I had to have the sheriff out to settle this, even when the sheriff interceded, the guy said in a proud voice that no woman was going to tell him what was going to happen & he admitted to 'using the gun to scare me' ; I really feel in some ways I think it would have been less stressful if I'd have had the sheriff come out when I told the neighbor I was refencing.
I lived in fear until he sold that land, every time I'd see a white pick up come down my one lane dead end road my heart would skip a beat.

Kathy maybe you are right......WOW...you do speak from experience. I've had
a gun pulled on me once before and I know first hand what that feels like..
(long story....another thread) it ain't good.....lets just say "I was lucky"....
or "Angels were definately busy that day"...whatever......Anyway, I will be
as careful as I can...I can't say what he would be like if challenged (especially by a woman)....as I really don't know him all that well. I know he
is ex-military and I would guess he owns a gun or two. I just want all of this
to be over....so I can go on with my boring life I kind of hope he just wants to see what I will do....He'll find out....

If he is cleaning up the other stuff across the line, I'd suspect he is more or less agreeing to what will eventually happen. I'd expect he either is waiting for help with moving the shed, getting around to it, or seeing just where the prop line will end up being if it is only 2 feet over he might want to see if it really is on your property or not.....

All in all, looks like things are moving in your direction - stay the course, you have been doing well so far.

I know of more than one woman who if he had pulled a gun on he would most likely have been carted away in a van with the words CORONER on the back. They carry and they are good. Very good. One even competes.

And not to sound too terribly sexist here but what kind of man needs a gun to scare a woman? I know what kind and I'm hard pressed to find any non offensive words to describe his type.

Quint, he is now serving a minimum of 10 yrs for actually using a gun on someone in another county where he wasn't 'connected' so at least he's off the streets. The guy was a total psycho!!!

If I had known he was coming over with anything but neighborly intentions, he may have been another of those 'dead statistics' since I too am quite proficient with a gun.
But by having him be my first official welcome to the neighborhood & KY contact, I did realize that not all smiles are friendly & started to carry that pistol anytime I was away from the house for protection from both 4 and 2 legged predators!!

Went out with the surveyor today. Indeed (as I knew) the pin had been
moved back 22.5 ft (into the trees) and out 5 ft 4in. Putting the shed a
little over 2ft over the line. The surveyor tells me it is illegal for "him" to move
that pin because he isn't the surveyor who set it originally. All he did was
confirm it for me 2 yrs ago. So he set another pin where it is supposed to be.
I called the original surveyor. He said because he is so far away that he would
have to charge me $600. to come out and move his pin. So now we have
the pin that was moved and a new pin where one actually belongs.
When we were out there today, no one was home. So, tomorrow I have to
go out there and talk to this guy about moving his shed. I will have to try
and find someone to go out there with me as I would like a witness.
I'll let you guys know what happens tomorrow.

Went out yesterday to "talk" to my nighbor. He said he didn't know anyone
had come out. When I showed him where the pin is, he acted like he was
all surprised and he couldn't figure out how it could have gotten moved???
In other words "he just played dumb"...I told him I would be putting up a fence and that the shed needed to be moved. He said he would move it as
soon as he can.....that he didn't know... :no: (Yeah right).....Then I told him
that I really didn't want him on my property with his 4 wheeler anymore...He said "O.K."....and went inside...(I guess to pout)...His wife then came out and said that they were not happy living here anymore. She said that in Maine (where they are from) people don't mind anyone using their land and
that they didn't understand people's concerns. I tried to explain it to her but I don't think she "got it".....Apparently they were thinking about selling and I get the feeling this may be what "puts the icing on the cake".....Anyway
thanks to all of you for your input.....The problem "seems" solved, at least for now....I guess I just have to wait and see if they do what they say they will do........Thanks to all of you for your support.....Kygardengal

Good for you! Thats called standing up for yourself, Im impressed.You set the moron/thief straight.

The house I live in stole about 3 feet from the neighbor(a lot,considering lots here are only 25 FEET wide!).She got a survey,went to court,judge said too late,awarded the property to my house(Old sidewalk, been there for years).Before we bought,not us.We fortunately are on good terms.

So stand up for your property lines,or lose it,it happens. My house is proof.

Someone suggested to treat neighbors harshly and disregard good (as good as possible) relations. Bad idea. First of all, it is not Christian to treat people poorly, even if they are treating you poorly. If you are in the right, you will prevail, so there is no need to make angry neighbors. Secondly, angry neighbors can make life miserable. They can call the law if you have loud music, fireworks, if your dog gets loose, or for whatever contrived criminal offense they might want to report. Nothing much can come of it, but it will by annoying to have the cops stop by every time they call. This situation seems to have been resolved well with minimal personal angst on both sides.

I'd get my hands on that property if humanly possible. You may never get the chance again.

I know of a guy that desperately wanted to buy the land of despised neighbor but the neighbor wouldn't sell it to him. Well, the guy had a close friend from out of state buy the land and then immediately transfered the property over to him. The despised neighbor was absolutely incensed when he found out about it but there wasn't anything he could do about it.

I want to be "optimistic" and think that I will drive out there and "Lo and
Behold" the shed is moved......but in reality, I know that he'll take his time
and I may have to say something again. I "AM" glad that "so far" we are all
doing well with this. I know that it "could" have gotten ugly...As far as buying
the place...I would love to....It is 2 acres with a double wide that is now 3
years old. I know for a fact that he paid 8500 for the land and he told me
he paid 60,000 for the trailer (new)...They have an above ground pool with a big deck...and the shed....It is very neat and very clean..She said she thought they would ask 110,000 for it. ....I am very sure they couldn't get that for it.....I already have a new house in town. For the right price,
I would buy it and rent it out to who ever I would choose....but it's not worth
the asking price....I think they are "dreaming"....My other neighbor has 14 acres and a newer single wide and they were asking 89,000. The wife is a realtor in town and they didn't have any takers at that price. They are nice
people and except for the property encroachments, have been good
neighbors. As a matter of fact, everyone around me is good...After these
folks realize that they won't get that for their property, I think they will come down on the price and move....So if anyone out there would be interested,
it is a nice piece.....

You won't believe my day today......

I got the wood post for my fence today...but you won't believe how.....
I was on my way to work this morning and there by the road side was a pile
of....you guessed it.....fence .....for free.......YEEEAAAHHH! ! !
It was an entire fence....250 ft of solid board fence that someone is throwing away.....all stacked nice and neat by size....all the 4X4 post together...
all of the boards together by lenghth......all nice and neat...I pulled over imediately and a lady came out and said...."please take it all if you like"
"yes mam.....thank you so very much"....I replied.... WOW...here I was wondering how I would fence the place....I am so excited.....I will use the
4X4 pressure treated post for my fence. I have enough boards for a large
shed or hen house..... All I have to buy is the wire and I think I can swing that part........This keeps getting better and better....Since I live in town, I was thinking about fencing my little back yard...The problem is that in this county you have to have a licensed contractor build your fence...So I thought I would plant some tall shrubs instead...but they are expensive...
I got to work today after making 4 trips to the farm with the wood and discovered "greenery" in the dumpster....You guessed it 16 Leland Cypress
shrubs 2ft tall still in their container...It seems they were donated and the
director says we have no place to put them, so she tossed them...Now I have
greenery for my town back yard and fencing plus for the farm.....What a day

In some counties in KY; yes you do! Warren County is one of them.

Heck you have to have a licensed contractor if you want the interior of your house painted in some counties! And we're NOT talking just in town!!

Unfortunately yes, you need a permit and it will only be granted if you are using a licensed contractor. We just bought a house this year. I was trying to negotiate a better deal if they would allow me to do the landscape myself.
"NO"...can't do that...your not a licensed landscape person. What about interior painting..."NO" your not a licensed painter.....Not only do you
have to be licensed...you have to be licensed in "this" county. You can't build
anything yourself here in Warren county. You know the "good ol boy system"
Either you are with them or your out....I have a friend who is a licensed contractor in another county....doesn't count...he had to get licensed here
to build here. (which he did) Building codes here are too strict....People who
want to build themselves just live in the surrounding counties where codes
are not this restrictive....

Sweet merciful crap!

I built an entire house here with ZERO permits or inspections. Nothing. The only thing was the assessor wanted me to tell him when the house was done so he could make the appropriate adjustment on my taxes. Even that was more of a courtesy so he didn't have to make a trip. I even assessed my own place. My assessment consisted of me telling him approximately how much the house cost or how much I thought it was worth. That was it.

I simply couldn't live with those kinds of intrusions on my life. I'd end up a profanity spewing lunatic. That or end up on the news for whacking nosy bureaucrats.

Judas Priest and sweet mericful crap!! lol I do have to have a building permit but all I need to get it is a drawing of the house...not a blueprint..just a rough drawing giving them an idea of what the house is going to look like. That's it..and I don't have to have anything inspected..my dh is doing all the electrical and plumbing and we have contractors friends that agreed to sign off on it and the county said fine..call us when you are done so we can issue you a CO..lol Gotta love country living!


KY** when you said you bought a house..did you have it built? Most contractors wont' allow the owners do work on the property because of the liability issues. Most builders make up a package deal..and have contracts with their contractors and if they build a house and dont' use the contractors they are breeching their contract. There are some builders out there that will build you a house up to 50% done and they sign off on it and you finish it up but that doesn't happen very often unless you are in a very rural area.
