Ok I know what your talking about but what kind of sense does that make (OK I know its the government thus it doesn't have to make sense). I'm still waiting to hear how they explain "property commiting a crime" LOL

Hey NUMB NUTS (65284), I said a lot of people, not all the people. Comprehend what you read.

Now I agree their are people who use ATV's as tools for the farm, construction job, etc. But around here for every farmer who uses a ATV for their farm chores there is probably 10 people who use ATV's for recreational purposes. And another thing I don't think just cause someone disturbed my fishing that all ATV's should be outlawed. I think that just cause someone disturbed my fishing that all WAVERUNNERS should be outlawed. As of right now I have never had anyone come splashing water all over me and rockin the boat with a ATV!

Lawyers will fleece anyone they can, but when they win all they have is a judgement that they can use to file a lein on the property. If a bank has a lein, then all the lawyer can get is a second lein, which means he will probably never get paid. That's why they love to sue outright owners. Someone was trying to fleece me several years ago and my laywer suggested I have grant my mother leins on my property to dissuade them from sueing. Leins are recorded documents but the documents my mother signed relinquishing those deeds the same day were not recorded but were notarized and valid.

Yeh - neighbors. I have one up the road who lives in Nashville and comes out a couple of times a summer. Out come the guns for target practices (so we get, blam, blam, blam most of the day). Then they use the road for ATV race after race. Last time I called the Sheriff's Office and they had a deputy come out and advise them it is illegal to run ATVs on public roads.

My suggestions.

1. Go to the county tax office and get the name and address of the land owners involved.

2. Send them a registered letter with a signed return receipt required formally advising them your property is posted and they are to, in the future, keep off of it without your specific prior approval. If they continue to tresspass in the future, call the sheriffs office each time to get a record of on file.

3. Send photographs of the spring to the out-of-state owner letting them know of the damage being done to their property and passing along their name and address and also mentioning you have formally advised them to stay off your property. Let the property owner deal with it.

4. Do not act on suspicious or might bes, such as you suspect they may have a meth lab on the property and the ATV might be stolen. Just happen to be looking for a lost dog (as in calling out a name as you go) and see if any evidence is in plain sight. If so, then contact the DEA for your state giving them the specific information on what you observed and let them deal with it.

5. If you know they are also riding on state forest land, call the state forester for your area and advise them of the situation (damage being done). Let them deal with it.
