Questions about shared wells

Thanks for all the replies.

There is nothing in the deed, we have had them double and triple check. The title company says since it was not recorded for them to find they are not liable.

The nieghbors attorney is saying they have a right based on an "implied" use because they always intended for the water to be supplied.

I have told them all along, A judge will have to tell me if I have to share.
The suit has already been filed a week ago (in the local paper) but I have recieved nothing notifying me yet.

Anybody sued there real estate agent for mis representing the property?
I'm sure you would have to prove they did it intensionaly.

Jeeze....I am not sure but should you file for water rights? Sorry about the huge hassle but I still think you are in the right. And what does implied mean anyways??? I am going to take your car....ok I implied I was going to take it so now I have the right to it? I know thats a little expreme but come on the land was sold the well ended up on your side I say u snooze u loose!!! Dont give in!!
