I had a pontiac montana who's engine went out before 50K miles (under warranty). I asked dealer for a new engine over a rebuilt (said I'd pay the difference even) and they said none were available. Could have been because they were phasing them out, I don't know. But, took over a week to get reuilt engine and then it wasn't any good. Ordered a second one, I waited again over a week, I got part of the way home and found it also wasn't any good. The next time I think I remember them ordering two engines, just in case, I waited over a week *again* and this one finally worked. It died at just over 100K miles, along with the transmission, so the van is sitting in the yard. Granted this was Pontiac, which I will never ever ever own again (there were so many things that had to be replaced, constantly) but long story short, based on my miniscule experience: I'd not accept a rebuilt engine even from the manufacturer if a new one was available.

I was also wondering why Toyota would pony up a new engine for a Nissan?

It was Nissan, and they were very nice. I really liked that vehicle......sort of wish we had never sold it. But we needed a bigger, heavier vehicle. So after about 11 years we sold it.

Very big difference between a factory rebuilt Toyota engine and a factory rebuilt Pontiac engine.

And truth be known, I'd take my chances with a used low mileage Yota engine over a re manufactured Jasper engine, I've seen my share of problems with them even with all new components. With a used Yota engine you are getting an engine with all Yota parts...no OEM equivalent or sub standard junk, crappy gasket materials and pistons made in china.

So if you sell someone a cow and the calf slips you owe them a new calf every year for the life of the cow? I would settle for a remanufactured engine with a good warranty and never darken their doorstep again.

Used engines, by and large, are fine. But doesn't the OP have a 2010 model year? That's a little new to let the shop go used. Factory reman on this one.

I exist in a harsher world than most that post here. Firestone has been working in good faith and for a reason. However they have yet to settle and their position is subject to change regarding a settlement. Lets say they flip the coin over. How many miles are on this vehicle? Why did the driver not see an idiot light indicating the oil pressure has failed. Is there any ownership of the fault on the extended damage that occurred? In court, probably so. In my opinion this issue is no different than sheet metal damage in a wreck. In a wreck it is difficult to get OEM parts. It is also difficult to get your repairer of choice unless they are on an approved list. In court how would you prove that someone did not drain the oil? It could get down to a he said she said argument. As for going to court this is a civil case. Who do you think will have the better attorney? Just realize where the experience exists. Do you see now why Firestone has provided the rental vehicle. Remember "good faith". Once Firestone makes an offer of what they are willing to do then, then the offer is denied who is not working in good faith? The rental will cease and then there is no transportation if the van is not usable. Time will always be on the side of Firestone and the likelyhood is that a compromise will be agreed upon. A shortblock crate engine is IMO is a good settlement. A complete new engine is out of the question and will get declined fast than I typed this reply. The insurance company will want to get by by giving a time period of coverage for the existing engine, I have witnessed this happening by GMC.

The down side of just a short block would be the heads could be damaged. Today with overhead cams the lack of oil could easily damage them. I would go for a remanufactured engine, not just a short block, all labor included.

It's almost 4 years old...very likely a vehicle sitting in a boneyard right now that is newer and less miles.

Ya true. In no way is a new engine going to be considered. If a year or less old yes but not one with How Many Miles On It?
You may wish for a new one, and want to be healed in that way, but all they are obligated for to make the person "whole" again. And a nearly 4 year old vehicle does not get a new engine.

Nothing. We are still in the rental and waiting on the insurance adjuster from Firestone to show up.

I don't think they'd like how I was treating their 'rental', if it was my work truck they'd cratered.... they might actually 'total' out the rental after I'd had it a week or two.

Oh, btw, they owe you a brand new engine, from Toyota... no ifs ands or buts. They might even owe a little extra for wasted time.

Okay-just talked to the dealership. Tell me if this is even possible. Apparently there are no new engines to be found. What I was told that Toyota builds the engine onto the frame of each individual car. So I can either take the old engine they have with 52k miles on it and a one year warranty or they can literally rebuild the engine I have and give us the same one year warranty.

What do I do now ?

I hope you got a new engine put in.

This is an example why you need to check your self after the work is done. I know people will say you shouldn't have too check your self that is what they are supposed to do. However my advice is to check the engine /car before starting every time you pick it up form a shop. Check everything every time. I have had lug nuts that were only hand tight /loose after getting new tires. . A tune up where they forgot to put the air filter top back on.

Both were from well established repair shops. So I advise check your self.

The rebuilt would have zero theoretical miles versus a known 52k on the other. I'd go with the rebuild.

Not really funny but they left a wrench on my alternator belt I drove it 1000 miles,then it overheated ..
