I'm glad you worked it out to your satisfaction.

What Elevenpoint said plus get the wheel bearings repacked if you can swing it. On my first vehicle the left front wheel fell off because the bearings burned out while I was going 65 down the highway. I had to hitchhike home a hundred miles in -20 weather.

hey, thanks for the heads up on those issues. i'll see what I can afford when the time comes. i've sure learned lots about how engines and vehicles in general work. I am pretty darned pleased at what solution came thru.

brrr nimrod, that was one miserable walk, ewww!

For anyone else looking at this, there's a basic principle in English Common Law that says anything sold must be "fit for the purpose for which it is sold". That carries over to just about every jurisdiction derived from English law, and that includes just about every state in the USA (with the possible exception of Louisiana, which may have been contaminated by the Napoleonic Code).

It might take a lawyer to find where that principle has been buried in your state's laws, but it's just about certain it's there somewhere. It applies to every buyer, every seller, and every item. If, as in this case, they changed the oil, ignored the metal particles, refused to let you have it inspected, refused a meaningful test drive (and inspection of the oil afterwards), then either fitness for purpose or even outright fraud laws could apply.

Chewi, I'm glad that it all is working out. And you've also learned a valuable lesson, if the dealer refuses to let your mechanic look at a vehicle, walk away.

We went thru a similar situation several years ago. My son's fiance' asked me to help her buy a car. She found one that she really liked, my son looked it over in the lot and they test drove it. She decided it was the one for her so I talked to the dealer for her. We hammered out the price details, then I told the dealer that I wanted my mechanic to look over the vehicle before we completed the deal. He said ok that's fine, then says who is your mechanic? When I told him, he said no way! I'll give you the name of a mechanic that you can take it to. We walked away.

Found out later that my mechanic had looked over another vehicle from this place and found an issue. The dealer agreed to fix it and did something quite wrong which made it appear that the issue was fixed. The mechanic found it and called him out on it.

yes, I've learned a lot thru all this. anyone looking to buy a used vehicle, esp thru a dealership, should look at those links on this thread. (but your own state's version!) it was those links that saved my heiney, I am convinced. without knowing the right terms to toss out, the rules of the game, etc., it was just me saying it was a bad car and its not right! altho that is true, just making this claim doesn't help a person in a bad situation! just makes you look like an uneducated dope.

and had I did all this before looking, I doubt I woulda bought this one. not without lots of revisions of purchase!
