Personally, I wouldn't. Not mine to pick.

Legally, tresspassing is entering someones property with the intent to commit a crime. Walking across someones property with no intent or means to harm anything is not s crime.
Nope, that's incorrect

Trespass:

Trespassing:

Trespassing as it relates to real estate law means entering onto land without consent of the landowner.

So, have you found someone to ask? GIS is a great source for looking up property owners.

As an aside I run a garbage route sometimes. I see lots of trees where the fruit is unwanted and unused.
I'm convinced a person could run a rather large "Virtual Orchard" simply by asking lots of folks if you could tend and have the fruit from their trees.
MANY seem to regard them as a nuisance and Ive seen several trees cut down simply because of the mess they make.
So ask away SPECIALLY on those in nicely tended yards!

If you can't, decide how much you want the fruit. Without the owner's permission, taking it is stealing. It would be a shame for the owner to waste the fruit, but it would be a crime for you to just take it. Maybe you'd feel better if you left notes in the mailbox and on the front door explaining what you're doing and offering to pay, but I wouldn't - that's just admitting your crime in writing.
Right of way is access only and not ownership.

P.S. If I knew where the family was, I'd bring them a basket!

Well tinknal you rabble rouser, youve done it now. Some say go pick, some say its illegal, some say its immoral and one suggests the death penalty for picking an apple not yours.

Seems to me its situational but in most cases not a good idea. You already smoked out one extremist just on this thread and now days you just dont know who is off a notch or two.

Did you pick or contact the owners? If I knew it was abandoned I would check with the neighbors first, then the bank/owner to get permission. Then pick a bunch...take a pie to the bank/owners if local. Just me though.

There are 3 houses on my property, but only 1 is occupied.

The other two may look "abandoned", but they are still MINE, as is the all property both in and surrounding them

I go around picking apples all the time, but only after asking. I wouldn't want anybody take anything of mine without asking, so I return the favour. If I can't find the owner, I won't do it.
There are some trees by the side of the road with no houses close by, those I will pick without asking, but that's it.
Usually everybody is more than gracious to let me do it and invite me back, especially since I offer to prune the tree in the winter.

You're saying there is no indication there are people living anywhere on your property?

I grew up on close to 400 acres. I wish the worst I had to deal with was someone wanting some apples.
How about a ten year old girl trying to talk her father into letting her try to cut her dog's leg off at the hock?

I would find out who owns it and ask, if you can. Around here, it would be better to pick the fruit than to leave it for wildlife, as bears will ravage a tree for just an apples or two. The tree would be permanently damaged...better to lose a single crop than to have the tree destroyed because it was neglected.

I would try to find out who owns it first. That is what I *should* do. What I should and would do are two different things, though, if you get my drift.

And to Shadow, the Bible says it is OK to pick crops on someone's land as long as you don't carry it off with you. According to the Good Book, you are allowed to pick an apple or a peach or a handful of grain from your neighbor's land, and eat it.

This is because even in the Old Testament, God did not want people going hungry, also attested to by the gleaning laws....

Geez louise take the apples don't look back and enjoy them. This is really not that big a deal. It is some fricken apples not gold bars sheesh

They are most likely organic is in no one lives there so unlikely any one is spraying them, they are only going to go to waste. Eat and be happy. Some of these people are NUTS!
