I just ran across this thread and I have some questions. I am having something like this happening to me. Our small town is installing a water/sewer system. We had looked at the blueprints, but it was hard to tell any details. I have commercial property in that town that I am buying from the owner (It's not financed through any institution) Now, I did not sign any easement or any other paperwork, and they have put the line and a manhole right in the middle of my property where we had planned to build a steel building. Right now we have a 50+ year old building that is about 20 feet away from the highway and my hubby is putting in a welding shop. This one is termite eaten and was just to make do until we had it paid off and could build this new building. Now we have this splitting our property and haven't gotten any response when we talked to city hall. We can"t build on it. They said they didn't have to get our signature on the easement because we didn't own at least half at that time. I just don't get it. It will affect me much longer than it will affect the guy I am buying it from.

The water line is going across your yard regardless of if you want it or not. Its an easment. I am not sure what they are asking you to sign, since they county can just add the easement to your property if they choose.


As for requiring you to use it no. they cant do that. They can however condem your well and force you to another source.



If they are having you sign any paper work say you will only sign it if you get a "FREE" tape on the line for later use. GET EVERYTHING in writing.

The tapes can cost thousands and in the future the water may be a better option and if you sell may be a big issue.

Many places that are putting in "RURAL" water system are requiring taps be paid for by the property owner. water companys want a guaranteed number of taps and its just easy to force everyone with a tap, TAX.
