BEWARE OF THE HOA!!!

They are sue happy.

I think you should buy a couple of old used toilets and plant plastic flowers it them guarded by plastic elves at the end of your driveway.

That is pretty good.. a big a sign as you can get spray painted with something to that effect: "BEWARE EVIL HOA AT <such and such subdivision>!!"

LOL.. I'm HOA educated (3 years time served).. and if any of them little hitlers starting threatening me with lawsuits when my property was there first (or even if it wasn't) and is not subject to the HOA covenants (most important factor) it would be a bloody war of attrition that I would surely win in the most belligerent manner possible.

All of that said, assuming they asked nicely initially I would have tried to work with them but that is assuming a few things. Like mentioned already I'm thinking there is more to the story.

They are just trying to bull manure you. Alot of people in life take one glance and roll right over.

If you have the free time it would be hilarious to establish an AHOA Anti-home owners association. Bring everyone surrounding the subdivision into the fold and make them aware of their rights.

Granted you have to be careful, your actions effect the subD's value, low value subDs bring in the unsavory crowds.

Also -if- they do actually take you to court keep that letter. Get a camera, video tape how far onto the property you have to go to notice certain things mentioned in the letter. You might not be able to prove who trespassed, but you can prove someone involved in the HOA trespassed on your property.

Not a hoa but a neighbor drove us nuts cause their 3/4 of a million $ house is near our farm.Well revenge is great!Yard art is not against the law,and with5 daughtes home yard art it was.A scarecrow family,toilet planters,you name it we did it.I told them if they back off we wont add to it but I would not take it down.Well one night it was all gone but so were the phone calls and letters,guess we reached an agreement.Fire with fire works.

I grew up on a road called Cow Creek Rd. There was a subdivision at the beginning of the road called Springdale. Years pass and more subdivisions go in...I jumped into the building business and helped build some of the quarter million dollar homes on a field I used to hay. Well, one family puts up some "yard art" of a few cows holding a sign saying "Welcome to Cow Creek!" The subdivision yuppies were up in arms...harassed the guy until he took it down. I miss that sign. Now, the road is called Springdale Rd / Cow Creek Rd. Fight, man! Make the HOA wish they never messed with you!

.we share a county road and there is no house when a good 600 yards of the south side of the place..

there only three couple with kids that i know of on the road that we share and they been there a few years..

i have been there since 1982 time frame and before that is part of my great aunt shelly home area..that she broken up and when she died she give it out the rest of the family who was in the military ..

she thought we should have a place to call our own ..for she was a military wife for a lot of years and her and her husband .david bounce around the world at times liveing in diff places in david retired out after about 35 years in the usmc ..

my peice of ground was a wedding day gift to me when i got married in 1982 ..she give to us so we would allways have a place to put down roots in area and not live a normad life style ..she told us..

they have a few for sale signs listed in the subdivision and i guess they are not getting the price for the homes that they are asking for ..i was told that today at lunch time..

also the county people are going out there to talk to them about the letter and to tell them to knock it off again..

in PHZ .AZ .. there is a day that they put up the pink flamigos day ,, to remind the hoa typle in the house there ..that there not in charge of the homes the people are..


i found today that the county planning people had been out to my land and found nothing wrong with the building parts that are going out with the all work up and beyond the code that they had set forth in the building codes ..


the phone call i got at lunch was from the county building inspector came out and looked around the place ..he told that he found nothing wrong with the place . every thing is up to code ..and second was that could come out and take a look at the place when i was completely finshed with the place and take a look ..

i told i have no problems with you comeing out and takeing a look anytime you feel the need to make sure i am staying in code..he told not for my job ..my i like to try what you are doing ..for i like the idea of a underground home and would like to get some ideas..for him and his wife where talking about the idea and how they like the basic of green tech liveing..



i have big piles of dirt and rock gravels ..along with pipes and other stuff out on the land right now ready to be installed ..had a concete truck out there this last week pouring the concete slab for the stowage shed form ..and the new fence around the land with a cattle gate set to drive over..


i going to call someone when they get off of work to night with the anti hoa typle set up and bounce the idea about..plus i know you owns the land going into the area ..i was thinking about putting up a sign saying something to the effect ..

we do not want your hoa in our area ..cross this line again and we have a war with you..and we will win ..with a nice big smiley face with those words around the smiley face ..

My gosh....I wish there were this amount of energy produced over something really important.

Either you are or are NOT part of the subdivision, hence the HOA. If you are, and having owned the property for as long as you have, you should have known.

If you are NOT part of the subdivision, move on to more important things. You can show your title to the court & have the last laugh.

As someone else said, there's things missing in this story..........

weds night i been up there and i going over the people who run the hoa and show the deed to my land..and i going to very nice when i explain to them that if they come my way again i going have them arrest for tresspassing on my land and i will not be playing them any more..plus my lawyer is going to be writeing them a nice letter about staying the heck of my land in legal speak so there lawyer can understand it ..

the whole thing is that this came into the area and bought the homes at really high prices and now that the area is going down hill because of the economy ..they are trying to sell and get the price that they paid for the homes..

we call it the cycle up there..

what happens is that you young and retire at 55 years old and now your 60 or 65 and starting to have heath problems and PHX is a three to four drive to see the main doctors for you ..now ok i need to sale the house and get down into the area where my main doctors are and been able to see them without a drive every time i need to come down there ..

we told them that the amount that you have paid for the house your not going to get in the end ..and they are not getting the asking price for the homes ..the whole area is going right along with the rest of the county about the economy and the price of homes are droping like crazy right now..

but i plan on getting old but not that bad off where i can not take care of myself along with i planed on haveing a person come and check on me here and there to make sure iam ok ..

i got a spot picked out on the land for a little place for me and my wife to rest in ..and i plan on building a place when i am up there and liveing ..after iam died and you burned me to ashs like we did with your mom and put my and her vase in the place there and seal us up into the thing and we you want to come and vist us as you wish ,.her vase rest on the bookcase in my place now ..everyone thinks it a really nice metal vase typle ..intill they go over and read what is on the outside of the vase ..it some my wife used to say when would get orders to the next place ..it has her birth and death dates and a metal craveing of her face into the vase ..along with two candles that sit beside the vase ..

the saying was from a willie neslon song ..on the road again ..

on a sidenote ..when my wife was really sick and we where going to the last stages of her life togerther ..we had went to the funeral home togerther to plan her funeral ..she ask the guy what was the cheapest way to burie someone ..my loveing wife beening frugal to the end..he told her the ceremation was the cheapest way to go ..and she ok let do that one she tells me ..she was the typle that never let a nickel go without makeing it scream first ..

she told me that the money we saved could go with the helping raiseing of the kids still in the house ..she also told me to have the wake in the middle of the park for her and not rent a funeral home ..

my land is deed to my oldest boy and he can not sale the land ..he has to live on it and take care of it ..or goes to the next kid in line if he does not want to do that ,.
intill some one in the family builds on and make a home again for there family ..

i venting some right now ..for every time i get four steps ahead in the game of trying to building on my land i get drag three steps back ..

iam on a really tight time table as it is and can not have any major porblems pop up in dealing with the home unit ..

Exactly one of the reasons I dislike living in PHX AZ: HOAs.

We don't have one in our sub & will never live in one that does.

I am sorry to hear that an HOA who doesn't even govern you is harassing you. For shame!

You need to go back and check your land title to make sure you are or are not part of a HOA. If your land is not then you have no obligation to anything they say. Even if every house around you is part of the HOA. HOA only have authority because you contractually give it to them at time of purchase of the property or the property CCR states your part of it.


Even if the land does have CCR to allow HOA control most startup HOA have very little money and try to muscle there way in. Dont allow it make everything go through there lawyer. Very soon the lawyer bills will exceed budget.

I had a home with no CCR but at one time had a HOA in the area. It died out and was no longer active. My home purchase had no notes about HOA and no CCRs requireing me to be part of one. When it start up it was basically a few mom's who wanted to fix up the little park. All in good, then after the first election you got a bunch of busy body's that wanted to control everything. My satellite dish was first. They send me letters saying its agains the HOA rules, I replied that home home was not in the HOA and send all further correspondence through my lawyer. I got one more letter through there lawyer then I suspect they got there lawyers bill and that stopped. Then they complained about a small john boat stored behind my garage, Couldnt see it from ANYONEs home owners property. The only place it was visible from was the parking lot of a local church and then you had to look to see it. Again I got a letter that boats couldnt be stored. I sent a letter letting them know that my lawyer would be contacting there. I got a call back in two days asking not to involve the lawyer. I suspect they didnt want dinged for another bill for nothing. every year or two after HOA elections I would get some busy body trying to complain about something, My door color was not approved, my trash can was metal instead of the required green plastic approved by the HOA. My car was in the driveway and not in the garage after 9pm as HOA requires. Now I stopped sending a letter to them and directly to there lawyer. I am sure he dinged them for $$$ for every letter he handled.

I have no issues with HOA who want to keep community areas cleaned up or cover some basic health and safety issues , but when you thing you have the right to control what I do on my property thats when I have issues. I am now in the country so dont have the issues.
