Hey.

If he doesn't make payment on time, he can be evicted and she can keep the money he paid in. A lawyer would view the email for a few $ and tell you if it is legally binding. Without access to the email, we can only guess...

move in with him

get about 10 kids and move in with him,,and eat ever thing in sight.

send him a certified letter stating he is to vacate the premises because he is there illegally.

then jump your sister for interferring and tell her she is responsible for his rent and damages......whose name are the utilities in........

have the biggest baddest rudest guy you know tell hime he bought it and will be moving the trailor..

Utilities. If she is the legal owner (on paper) of the trailer, then she can contact all of the utility companies and demand that they turn the utilities off, as it is vacant and there is no one living there with her permission. Then, have her contact the county clerk's office for eviction/repossession paperwork forms and fill them out. It shouldn't cost much and she should be able to do it via the mail. Frankly, if I were her, I'd make her sister do most of the legwork since she gave the guy the key.

Tell her to relax, things will work out.

Call the police back and ask them this. Say someone goes to a car dealership and takes a car for a test drive. They offer the dealer less than half the price and the dealer refuses, but the customer still has the keys. He goes out to the parking lot and drives off with the car tha he made a ridiculous offer on, but he has never paid for it. Did he steal the car? Of course he did. This is no different. I don't know what state this is in, but is most likely grand theft. Tell the police that you are filing a police report for grand theft. You didn't sell the trailer and he didn't buy the trailer.

A contract is offer and acceptance, in writing. You offered the trailer for $5,000 and he didn't accept. He offered $2,000 and you didn't accept. There is no contract. He has now stolen the trailer, and the police are derelicting their duty if they refuse to act. Make a stink. Call the news, call the newspaper, local radio, whoever will listen and put the screws to the police to act.

What state is this in?

I would say that was breaking and entering. She did not give him a key did she?? Its her place. I would call the police and tell them that. Tell them that you are bringing her home and going in and if someone is in there your going to shoot them to protect yourself and your home and they had better get there first and get him out and arest him for breaking and entering!! Just because you are out of state for awhile dose not mean anyone can just move in. Tell them if he says he is renting then let him show the rental agreement!! He can't thats because he broke in and lived there while you were gone!!!! If that dosn't work then ask to talk to his SGT and if that dosn't work then call the local DA. Tell them you are comming home and if they don't want to haul away a dead body (yours or his ) then he better be in jail when you get there.

I can think of several easy ways to deal with such a situation, but they will all mean jail time if otter gets caught.

If indeed there is no legal contract (and I dont recommend going to jail, its a smelly noisy inconvenience at best and much worse usually) Talk to the county attorney, and he/she should set the sheriffs office straight. I would insist the sheriff serve eviction notice on the rascal.

Cop hate any stink besides their own you just have to make a bigger stink than the guy in the trailer.. CALL EVERYBODY! Have them CALL EVERY Law enforcment officer and politician you can find.

i think the poster said the trailer is in pennsylvania. that is sad because if the tenent "cough" is brought before the judge for eviction (or perhaps if the "tenent" fights eviction), the judge may end up giving upwards of 3-4 months in 30 day increments before a sheriff will evict him.

this is a very odd situation...i bet the guy knows what he is doing and will be a pain to get rid of. i wouldn't let another day pass before i talked to the police again and ultimately a lawyer. otter may be able to get legal aid to help in the process if she cannot afford a lawyer. i think the first step is definately to pressure the police to actually do their job.

I thin/hope that when they settle she will have more energy and time to really get nasty.

If I were Otter, I would not depend on my sister anymore for anything, including fixing the situation. Even if she got suckered by the lowlife, it could happen again with getting it worked out.

did she cash any checks or take any money from him? if so then there is a contract. My friend found out the hard way that even taking 1 dollar constitues a month to month agreement.She needs to find out what the eviction process is and start it immediatly - don;t wait til the 1st of the month, get it done this week or she may lose another month.

Otter is going to try the actual Sheriff in hopes of getting some action.
She did cut the utilities and the guy has turned them back on himself..that may be worth something as far as a fight.
The guy is a real piece of work, full of threats and violence..gun waving etc...
So once she gets settled I hope she can go after him with a vengeance and get the police to actually do their jobs.
It costs too much to have it towed off...

Situations like this is one of the reasons VOR always councils against being a cop caller. Otter has severely limited her ability to respond by notifying law enforcement. She should have just shown up with a few friends and treated him like any burglar. Sounds like he needs a bullet in the gut to learn a lesson.

Contracts for real estate must be in writing. She also does not owe him anything for any work he did to the place (I doubt if he really did any). They had no agreement to do that work. I can not just show up at someone's home and put a roof on, then bill them. He can't either. It will cost her almost as much as the place is worth to get a lawyer involved.

Hopefully, the sheriff will take action. If not, it is time to find a few good men to send over to handle this for her.

You still didn't say if it is a travel trailer with a title or a mobile home. If it is a travel trailer and she can find someone to tow it away she is within her rights to drive off with it. Just like if the guy was living in her car.

If I was going to PA anytime soon I would tow it for her. Got a good place to hide it too.
