I wasn't out their to find him I was setting out waiting on a Deputy that was supposed come by and I saw him.

So you equate throwing some light on your property so you see what you're taking a shot at, and whether there's more than one person out there to hiding under the bed? Not sure how you reached that conclusion.

And if he had posed a risk to you wouldn't he have already taken a shot at you sitting out?

I'm not even second-guessing what you did - all I'm saying is it may be wise to sit down and think what you can learn from the situation so you can avoid shooting at shapes in the night again.

Yes I know the law in Arkansas and it says you can't shoot if they are running away or stop the threating maneuver. You are correct that I felt threatened by the maneuver he was displaying. Now I could talk to him in a civilized manner and get him to quit or I can shoot at him and hope he had a gun. I chose the last one. Since I missed and no one has complained to the sheriff everything worked out for the best. I went over the law with the Sheriff and a State Trooper and they said I was right.

Long enough to get up from my pickup tail gate and walk around to the back wheel and shine a flashlight on him and say hello.
It was dark where I was at and he didn't see me before I said hello. I could have let him do anything but saying hello seemed to be what I decided.

Old Vet, regardless of what anyone thinks you should have done, we know two things that are definitely true.

1. There are some people who are willing to come onto your private property and steal from you, and

2. There aren't as many as there used to be.

So, you were just sitting on the tailgate of your truck in the dark? I do that myself sometimes.

I can see having a flashlight with you but do you always have a gun handy....just in case?

Yes I have a Concealed Carry Permit and I always have it with me unless it is illegal to go into a place and then It is in the car.

That is the first intruder that I have had in 9 years. I always carry a pistil because of the wild animals that are around. I have run into a bear a bobcat a cougar many coyotes and several snakes.

Sorry, you can be funny all you want, your story has no relevance to the original post.

There was no warning. There was no dialogue. There was no NOTHING. Yet he shoots to kill someone. Your story was full of dialogue, justifiable threat, warnings. there was NONE of that here.

Your mail man story has nothing to do with this, however cute you think it is.

Old Vet stop. Please. You are enduring more of an intense interrogation from your fellow homesteaders than you had to with your local law enforcement.

You owe nobody here an explanation, nor should you be continually asked for one. Your friends don't need an explanation, and your enemies won't believe one (or two or ten.)

I feel compelled to say I am disappointed and uncomfortable with what I am witnessing here ... I suppose I was naive to think we were like family here ... you know, kindred souls gathered in one safe-havened place to share our unconventional lifestyles with one another without being attacked, made fun of, and/or ruthlessly questioned by our choices and experiences.

I am sad.
