While I always ask a landowners permission before hunting, a hunter who strays onto unposted land is neither tresspassing nor poaching.
You MAY be right about that where YOU live, but in many states, it's ILLEGAL to hunt (or otherwise trespass) on ANYONE'S land without express permission, even if it's NOT POSTED.
North Carolina requires WRITTEN permission, granted within the past year to hunt with a firearm on any proerty you dont own or lease.
Generally a person cant be ARRESTED the first time if it's not posted, but they are STILL trespassing

I call the game warden & let him know what I am about to do. I usully tare wooden stands down & chop them up.
climbers & other store bought stands I saw up with my my cordless saw . I leave them under the tree so the poacher gets the message. The game warden says that I am asking for trouble but am in my rights. the last climber i cut up was a nice one it was up a tree with a posted sign ON THE same TREE!! the stand WAS a $300.00 climber

Better yet let the warden have the stand and leave a note that the owner of the stand can pick it up at the regional Fish and Game office.
If the stand owner knows he was tresspassing he won't pick it up and if he is dumb enough to pick it up he will be ticketed. Either way the stand owner knows F&G is involved.

I'm glad I don't live in New Hampshire! People are allowed to hunt your land unless it is posted, and the state strongly discourages landowners from posting their land.

Beaners, here is the info you need:
http://www.dec.ny.gov/outdoor/7844.html

Trees and other plants on private land are private property. It is illegal to cut or remove them, or to cut limbs or damage bark (such as from putting up blinds or tree stands, or cutting shooting lanes or trails) without the landowner's permission

It is the same thing in Arkansas you must post your property unless it makes no difference to you whether it is hunted or fished. There are several ways to post property and they are expensive you just cant put a sign on the road and call it posted.

Guess I'll stay out of Arkansas too. I like the idea of people not being allowed to hunt on my property unless they have written permission.

All you need in WI is a fence. Used to have to post it. Had several run ins with folks dragging deer out of our woods to a truck parked right in front of the posted signs.
If no one had permission to be there with a tree stand, consider it a gift and do with it as you will.

In Missouri you can post your land with purple paint. It's the same as a no trespassing sign. I do both. I have purple paint and I also have signs every hundred yards or so. It takes a lot of signs but you can buy them in bulk and even have them personalized with your farm name and such for a nominal fee when you order them in bulk.

I'll pass on commenting about the removing of stands...

When I put out a deer stand, it's usually 'built' or put there, to stay forever. I put mine on lands I lease or own. So, if someone put the stand there, odds are they put it there to stay... at the end of hunting season, quite a few areas are inaccessible with vehicles, and moving stands would be a major hassle, especially if they were going back in the area again next year.

If the stand were on some of my land, that I didn't personally see every week, I think I'd paint it bright orange... if it can be seen from the road, the 'owner' will notice it when they drive by, and think Hmmmm...

A lot of people don't realize that there is no such thing as unused land... if you own property in the next state over, or several hours away from where you live, IT IS being used, by someone... either legally or illegally. I'm a strong proponent of having someone use such lands legally... by contacting a neighbor there and ask if they'd like to lease the property for whatever, and the only cost being, to call if there's a fire, or others causing damage. Nothing like a neighbor with a vested interest looking out for your property. If he has no interest, he'll probably not care if it's being used as a dump or an atv paradise...

Adverse possession

Did u ever hear of adverse possession?
I know a man that lived downstate, and had property in Upper Mchigan
One day he found a hunting stand on his property ,he called the state police
police found stands owner, who claimed the stand had been there over 15 years
Police informed property owner ,he couldn't remove stand.
Stand owner filed law suit (Adverse Possession )
After thousands of dollars for legal work and attorneys , property owner lost
couldn't remove stand ,and lost property stand sat on.
Do yourself a favor remove stand ,post property and don't say any thing.

Hey.

Tear it down and cart it away. No lease gives the right to build a structure on said property.
