I don't see a quick solution to this. I'm hoping they find your tranny, but if its lost, it could drag on for months before the trucking company ponies up a couple hundred in your direction.
A copy of the signed bill of lading is where you need to start. This will have a description of the item shipped and the freight class. The freight class can be referenced to show how much $$$ per pound the shipment was insured for.
Generally, items are shipped in general freight classes, which results in lower freight costs. The downside to this is when items get lost and they are insured for a pittance of their actual costs.

Think I'd be looking for another tranny ASAP, because the possibility of a long drawn out fight on this with little financial remuneration your way, is a VERY real possibility. Putting yourself in a position where you have to rely on the actions of others is a most undesirable position to be in.

The trucking company is NOT in any way responsible for rental vehicle costs.

You need to take actions ASAP to bring about an end to the rental vehicle costs.

Undoubtedly, you're getting a raw deal that will cost you some money.

The freight company is called Diamondback, also in Phoenix.

I admit to price-shopping, because the rebuilders in Kingman wanted almost $800 more for the same thing....

So have a friend inanother state call them back and see if they have one in stock.
If they do call your mechanic . Tell him to call and get them to send it NO IFs ANDs or BUTs Have him point out the problem is between them and the trucking company they chose. That he has the papers that show he sent it and after that its their problem As far as he knows its sitting on the dock there.
Have him point out he is facing a sizable lawsuit from a carsy customer whos uncle just happens to be the judge there so they wind all sorts of crasy things.......yada yada yad ....get on it!

Does anyone know why I don't own and operate an auto repair shop any longer??? I do, I do!!!!!
You didn't want to pay the money for the transmission the shop was comfortable buying/dealing with because it was too expensive. So you shopped and then talked the shop into installing the trans that you bought cheaper and they made no profit on. Am I getting close?

Freight Claims!

1. Most carriers have up to 180 days (6 months) to settle a claim.

2. Only the shipper (tranny shop) or consignee (rebuilder) can inquire about a claim. And the only one with any leverage is the one who is paying the bill. They are the one who will take their business away (and the income stream) from the carrier. And the carrier may choose to ignore them if the claim is bigger than the current or future income stream (as a former freight salesman, I know this to be true ).

3. You should be making your claim against the business insurance of the tranny shop or the rebuilder (whoever selected the truck line and is paying the freight bill). That is the party that has "injured" you. They then will have to settle up with the freight line.

4. As your husband found out, talking to a Terminal Manager about non-operational problems (stuff that affects him personally), is a lot like teaching a pig to sing, frustrating for you and irritating to the pig (they are not very customer-friendly people ).

Beeman, you're wrong. The mechanic told us up front how much extra we would pay him to put in this tranny, and it was STILL $800 less than the "local" one available. Same warrantee on both. This city is on I-40, they are used to soaking travelers who are broke down on the 40 and have no choice, I think.
The tranny "miraculously" showed up at the rebuilders, but they say we have to live with the noise, as there is nothing wrong with it and they won't "fix" it. Some warrantee...

But chances are very good that the more expensive one would end up the same...a warrantee they aren't gonna honor, since they are used to dealing with travelers from out of state. And if the tranny was to fail, it would be a 5 hour "drive" or shipment to get it back there, as my husband won't be there a lot longer. At least the cheaper tranny is out of Phoenix, where he "normally" works...
