Around here the Surveyor uses Rebar with a Plastic Cap that tells who did it.
I had one guy take a Bobcat take out one fence took the Survey Markers out.After it was all over I had to pay to have it resurveyed and put up New Fence.  Plus they hauled me to Jail for taking a Ballbat after him.
I know suppose to Survey but around here it just don't seem to do any good.Plus its going to cost me $2,000 every time they pull the Markers and throw them in the brush.

I've helped my dad survey, and I do have one suggestion for you. The above ground markers are tempting targets for kids or anybody else. People just love pulling them up for some reason. We always drive a pin underground about 2"-3" beside the above ground pin or stake. Most surveyors do that. We use a metal detector to locate underground pins. Just a thought.

There are some state that if you let a neighbor use your property with your permission for x number of years they can claim it. I would check out land laws in your area.

Don't know exactly what the laws are in Missiouri.....but the last I heard around here and most other places, it's a FELONY to remove/move a surveying benchmark or survey stakes.......just wondering why it was you went to the pokey and the bobcat guy didn't???

Well just got off the phone with a Guy talking over all the Legal ins and outs.The Fence don't mean nothing until it has been up for 25 years.If I have it Surveyed you would think that would establish the Line. But not really in the long run.I have a small place where the line is running across my Drive,with that it is a different matter it only takes 3 years for that to be considerd access to my property.Which it has been longer than that.
Either way he said that I should have the place Surveyed and hope the neighbor,lays off.

Because his Brother was in Upper Local Goverment.I tried running against him and he had my name throwed off the Ballot.

When I bought my place last year, had a dispute with neighbor over property line (no fence on one side). I spoke with a real estate lawyer, and he told me to build a fence on the line and make the neighbor file an injunction to stop me. In other words, make him pay to file with the court. I didn't have livestock at the time so didn't need a fence, so I set big cedar posts about every 50' all the way across the line. I had no more problems. Now he's building a fence so he can use the 3 acre lot for his cattle. If you've got a survey, put up your fence, make him file to stop you. Lawyer told me a survey trumps a fence anyway.

Just to set things straight, no one can have someone else's name thrown off the ballot for any reason besides actions that would no longer enable you to be qualified as a candidate.

They said I broke Ordinances that made me ineligible to run.Things such as my Dogs running loose without Tags.My Chickens stinking,things like that.
But the Goverment in this area was all related.Plus I made it known there would be a House Cleaning in City Hall if I was Elected.

There is a trial going on in our area for a man that "lost his temper" and shot and killed his neighbor and his wife and injured their son, over a property line dispute. Sadly he will probably now spend the rest of his life in jail, ruined his wife and family and the neighbors son. Where the property line is now is not important to anyone. Please, don't let him turn this into something bad for you and your family. Life is too short. Can you let the officials settle this?

well...around here what people do is put up a fence with the finished side facing the neighbor about 5 feet from the property line, that way they can mow and trim along the neighbors side of the fence to keep it nice (but still be on their own property). Me, I prefer to drink beer with my neighbors rather than fight with them.

Rock, I know how hard it is to have a property line problem with a neighbor. You are right survey beats fence. I did a survey, they did a survey. Both found the leachfield on my side of the line. Neighbors put in a new septic system(title insurance company paid for it) Neighbors still say that the surveys are wrong.
In most states it is illegal to pull the survey pins. I had my surveyor sink them in the ground, not only in the corners, but several along the line. These can be found with a metal detector.

The Law won't come up here.Hard enough to get the Fire Department here,if they come their mad about it.
One Deputy got in trouble because he came up here.He got lost and the Sheriff wanted to know what he was even doing up here.
