It can be a big fuss for some people....often the owners are paying a mortgage on the rental property, so basically if the lousy tenants don't pay, the owner has to find that extra cash somewhere (if they can) to pay it for them.....if they don't pay it on time, the bank will charge them a late fee on top of it. Imagine being stuck with a late fee every month because of someone else's laziness? What about if that one little month means a $1000+ rent payment? 'Someone' has to pay that! I don't know about you, but I would get fed up very fast.
Why do so many people assume that rental property owners are rich and can pay the tenants' way for them? Sometimes the only income an owner has is that rental property.....should the tenant just say, "so sorry, you don't get paid this month?" Arggh! How inconsiderate is that?
And no, I do not and have never owned rental property. I have been a landlord for an owner, though, and have seen my share of people who think it's ok to live for free off someone else. Pathetic.

Your Case Makes Me Feel Better About Mine. We Have A Rental Agreement In Which She Has To Give Us 30 Days Notice If She Leaves. She Pays By The Weeks So By Florida Law We Only Have To Give Her 7 Days Notice To Leave. The Rental Agreement Is Not For Any Specific Time Period. So We Dont Have To Give A Reason To Evict Her.
As Am I Her Next Door Neighbor And The Rent Collector For The 5 Months She Has Been Here I Have Been Cordial And Bent Over Backwards For Her. No More..... Thanksgiving Day - She And The Bf Out There Altering Our Mutual Parking - Turnaround Area - I Could Not Get My Car Out Due Their Activities, Ask Her How Was I Gonna Get Out.....she Curses Me Profoundly And Goes And Moves One Of Their Vehicles Out Of The Way.
I Immediately Resign As Her Rent Collector. Dd Informs Her By Phone Of That....that She Has To Give It To Dd, Then 4 Days Late The Renter Comes Over To My Front Door W/the Rent As Usual And I Stand At The Window And Tell Her If She Has An Emergency I Will Try To Help Her, But That She Has To Give The Rent To Dd.. She Screams And Hollers At Someone Across The Street.
I Go In A Research The Florida Statutes On How To Get Rid Of Her. Have Sent The Info To Dd......we Are Giving Her 30 Days, Cause She Does Keep The Place Clean And Pays. If She "shows" Herself Bad Behaviour To Me Again....there Are Other Laws That Apply To Immediate Eviction In Florida.
Florida Statutes Can Be Downloaded. Plus Our Fla. Dept. Of Consumer And Agriculture Services Has A Downloadable Brochure.
Sorry About Your Problem.....have Been Wanting To Vent On Mine.

It depends if you are going to try and go after the back rent that they owe you or not. If you don't and just choose to evict them, then it will take less time because they don't have to be served personally (they can just post the eviction papers to the door).
I won't go against your attorney's advice, because I'm not a lawyer. But I have had rental property before and I personally would not wait that long. YMMV. Follow your attorney's advice.

update
well, we went to court. my lawer called them aside. Basically told them to pay up and get the hell out or the sheriff would move them. Hud told them unless they paid up, they would not help them with the rent anymore. so they moved out 2 weeks later. left it dirty and lots of trash. but a money order for all the back rent on the counter. if they had left it clean, i would of gave the deposit back.
so i came out of this well.

You got lucky lucky lucky... follow Ken's advice the next time 'round. Heartless? Nope... just regimented and prudent. You have an investment, and you have to maintain it. Visual inspections are fine, provided they are infrequent and scheduled.

According to the state you live in it will be after they are 90 to 120 days behind before you can start eviction. We never had an eviction in all the years we did rental . Just offer them a months cash to get out by friday give them a week. I have payed $500 to get people out. sigh an agreement that if they are gone and the place is clean they get the money. You have already lost the rent why lose a nother months rent or more plus court cost, plus attorny fees. It works and is cheaper.
When they get out of the house fix it up and sell it get out of the business. If present day renters are capable of paying rent on time they can own their own home the rest for the most part you do not want them in your rental house. Just our thought on the subjuect,.
\ We have just donated our last rental unit to the local fire dept for practice. They are going to burn it for training. The last tenat did so much damage it is not repairable. So FREE AT LAST THANK GOD WE ARE FREE AT LAST THE RENTALS ARE ALL GONE

the house that katie just rented, the landlords did everything by the book in triplicate and it took the 8 months to get rid of the tennant. Smart deadbeats can play the system like a steinway piano.
they got no rent, ever out of that lady. one day in court she had a death in the family the next she had a heart attack the nect she had some onther story the local judge saw fit to take pity on for another 30 days. In the end, the sherrif finally had to come and take her out of the house and lock the door.
I once thought landlords who had 20 page leases with 100 conditions and all that nit picky stuff were jerks, until i got screwed too as a landlord.
make it 40 pages and take 100 photos of the place before they move in.... and every few weeks come take more pictures for your records.
I dont know if you can but i figured if I ever rented again i would make it a written agreement that I have permission to enter/inspect the rental unit on the first of each month, so even of they cant be reached, they know and agree, I can do it.
one appt she had the landlord had that kinda in his lease, "every 8 weeks" she had to agree they could enter and do a walk thru even if she wasnt home. [she made sure she was on those days and he never actually did] I think he added that to see if she would protest... good trick!
I dont envy the headache youll have in 2 weeks.

We have been going thru this for over two months now. She is not living in the house and has been 'gone' since before the end of the eviction date. Windows were open with heat pump going wide open, no screens, no blinds trash everywhere, no rent or electric in 2 months. We have called her over 20 times and left more than 16 messages.... no reply. So, we went in the next am after I saw a raccoon climbing out the window w/ trash in his mouth! Worst mess you have every seen... Had rotten food everywhere, dirty underwear everywhere, dishes with rotten food. But she also left: 30$ in rolled coins, 100+cds, lots and lots of dishes, clothes, pictures on the wall, glass shelves--all the big items were gone. After three weeks, we started to clean it out....  So far we have removed 3 truck loads of pure trash, 1 load of bad/rotten food/ with dishes... We went thru legal channels. W/ damage, electric, past due rent we are out about 2500$ (she had $600 deposit)If we were able to sell what's left that's another 150$... I cried for days.. DD is now cleaning, painting and will be moving in.. Can't wait. I know the house will be cared for and the rent will be paid on time...After she moves out we will sell both houses and move to the farm, if I have to live in a tent... Good luck.

LOL, I was thinking the same thing. Makes it a bit hard to read as we are trained (well, at least use to be trained) only the first word of a sentence then then proper nouns, etc. were capitalized. But then, hey, a bit better than all capitals with no paragraphs.
I am aware I may have come off as blunt in my suggestions to a landlord, but they are based on experience. Extreme case, but one time I got a HUGE water bill. Tracked to down to one apartment. Commode flapper/stopper didn't work properly and commode had ran for quite a while. Asked tenant about it and they said they kept forgetting to tell me about it. I asked how they flushed the commode. They said they would take the top off the tank, hold the flapper down until it filled, used it and then flush, to let it run again. A less than $5.00 repair if they had bothered to tell me about it.
And, yes, there a trade-off between a landlord's desire to keep the property in good condition and a tenant's rights to privacy. If you don't like the landlord's terms, then don't rent from them.
At one time I had a tenant who I was 99% sure was selling recreational drugs (weed from the smell) out of their apartment. However, they paid when due. My only real concern here was DEA busting down the door and the repair involved.
Essentially I learned the old give them an inch and they will take a mile.
On weekly or every two weeks payment, there are 26 two week period in a month or 52 one week period or it is essentially getting an additional month's rent.

As several of the folks on this board have mentioned, you definately want to know the law.
I was on the other side of the door for a while - DH & I had a landlady who, when he moved in, despite the fact that in TN she is entitled to no more than their name & an emergency contact number, insisted that he and our housemate had to fill out an application to live there (I had already been living there with just my name on the lease for about five years). The language of the application was more permissive of what she could do with that information than the background check DH signed to work in the Pentagon. Essentially, it said that she could use the information (which I think included SS#'s, bank accounts, etc) to whatever purpose she wanted to. After fighter her for several months, we finally just gave up & moved to Missouri, as this woman was determined to make our lives as difficult as possible - she was going into our (locked) mailbox from the back side, was reported to the post office for several offences, and otherwise made our lives miserable.

Just A Hint! make your security deposit diferent than your rent amount a bit more is best.that way they dont think of it as a free months rent.
when someone is late give them written notice the first day they are late then the first friday after that go to them and say look heres the deal I can rent this apartment NOW if you can be out by the end of the weekend and to help you out Ill give you $XXX usually they will take it! In my case if the rents is 700 the deposit is 950 and Ill offer them 800 to get out,then I deduct it from the deposit and last months rent.

Rentals are something else. Some you get good tenants and some you get trash.
We are still working on a 3 BR 1 Bt that a couple moved from at the end of Jan. I had been in it 6 months earlier and didn't think it was too bad, and the lady was cleaning it then, we were repairing a leak in the bt vanity. In that time, they got the place so filfty and nasty, we had to wear masks to clean out the trash.
They let the mice take over and had an inside dog and just let it go where ever it wanted. They did not mention anything about having mice. You would not believe how much damage mice can do to a place when they are treated like pets.
The stench was worse than a sewer. Its been 2 months and we almost have it ready to go again. We can go in without being hit with the smell now. Had to rip all the flooring covers off and replace. Repaint the place. Clean and clean some more.
Oh well, I will rent it again to someone. I don't rent any of mine until I have them cleaned and fixed good enough, to where I would live in them. I just don't have much use for the people who leaves them like the previous tenants I described.
It is so hard to figure out who will be a good tenant. These had good jobs, good vehicles, well known in the community. Who would have thought it?
