The Supreme Court ruled on Monday that the government-imposed assessment on beef producers to pay for the "Beef: It's What's for Dinner" marketing campaign does not violate the free-speech rights of dissident ranchers who want to opt out of the program.

Coming after years of constitutional confusion over the many similar programs the Department of Agriculture oversees, for a variety of commodities like cotton, milk and watermelons, the 6-to-3 majority reached its conclusion through a new analytical route that is likely to end much of the courtroom conflict, if not the policy debate behind it.

The speech at issue was "government speech," Justice Antonin Scalia wrote for the majority, and as such was not subject to challenge under the First Amendment. The decision overturned a ruling by the United States Court of Appeals for the Eighth Circuit, which had declared the beef program unconstitutional as an instance of "compelled speech," reasoning that it forced the dissident producers to subsidize a message with which they disagreed.

Corporate welfare. Tax the wholesale commodity producer to pay for promoting corporate retail product. Beef will soon be like pork and chicken where you produce it under contract to the processor/marketer. You become peon laborer on your own farm basically working for wage while corporation dictates everything you do. And I bet they still tax the peon contract "farmer" to pay for their corporate promotions.

the feedyard portion of beef is already pretty close to pork and chicken. However, the calf/stocker portion will never reach that status because of the nature of the business. Of course, there are dairy herds in which calves are being raised that way. The only way to stop these corporate control issues is by buying from the small producers. However, the small producers must charge more because of the lack of "economy of size". We each have to decide what we are willing to do.

Not until govt BACKS OFF, MAN!!!
(We didn't eat it before - crappy feed and mad cow issues - so it makes it hard to boycott it now. But if they were to resolve the mad cow problem, we still won't eat it.... so there! Nanny nanny boo boo!)
