I don't know what states you are referring to, but it's important to remember that very often the real story behind things like this turn out to be a single state legislator who is either just plain stupid or trying to get attention.
Here in Virginia, there was a bill proposed that would make it illegal for people to wear baggy pants. That will never, ever become law. It was only one guy who wanted some media attention that proposed it and it got killed in committee immediately. It's important to remember this when you hear that 'the government is trying' to do whatever. Usually the danger is essentially zero.
Of course, sometimes the nutcase who proposes something like that happens to be a big wheel in his party and his party just happens to have a monopoly on the entire government in that state or in Washington DC. When a party (and it is true for either party - this tendency has no favorites ) has a monopoly like that, suddenly the whole process by which nutty bills (like making it illegal to drink your own cow's milk) get debated and shot down just disappears. And then the most preposterous laws start getting passed right and left.
Anyway, so long as you have checks and balances on power with different parties controlling different parts of government I wouldn't lose any sleep over these proposals. If you live somewhere that this is not the case (such as under the US federal government at the moment), be very afraid and make as much noise about it as you can.
