Free T-posts?

Our road was paved just over a year ago. To help the ditch not erode the road crew put T posts and a plastic barrier to prevent dirt from our property washing into the ditch. Now the plastic is weather worn, and the grass has grown in well. SOOOOO the post are still on our property and I am wondering if we can pull them and use them or will it be stealing? Will the road crew come back for them?

Call the people that put them there. If they give them to you their yours if no they are not yours. Taking anything that is not yours is not a good thing. Twice I have cought people loading up stuff here on the farm and their reasoning was well you were not using it. Both times it was something I would have given them so I turned them over to the sheriff and the judge explained the fine was for stealing and if they did it again no matter what their reasoning they would get time. Bet they give them to you

One of the workers told me that "they" hope someone will take them up "After they(the T post barrier) have done their job" He said that after all the dirt has settled and/or grassed over "The contract crew has so much time to get them up--I think he said a year, guess that would vary from location to location. He said it makes him and his Boss happy when they go back to get them and someone saved them all the work. Around here the light line crew etc if they have to take down a tree close to they road, they offer it to the land owner if he is around---if not they saw the tree into fire wood lengths and pile/stack it so anyone can stop by and load it and they hope some one will. Take them if they have done their job !!

i know if someone leaves something on your property for more than 6 months its already your property.. same thing if i car is left on the side of the road.. after it sits for 6 months its free game.. but thats alabama

County left a road grader parked in a waste corner of a farmer's field.

The next day I'd sent the county a bill for storage and place a lien on either the grader or the court house until the bill was paid.

You mean it's easier to just go buy new ones next year when another road is done? You live in a rich county. In ours, the jail crew would be taken out to gather them up for reuse. Before scrappers get to 'em........

Call and ask. Take you 2 minutes, tops.

Right now, they aren't yours, so if you take them without permission, it is stealing.

When calling about them, if you are going to, make sure the person taking your call understands that you aren't annoyed by the posts being there that long. I'm just seeing some county worker marking down the call as a complaint from a landowner that the county left stuff there, and then sending a crew out to get the posts because they don't want you to complain any more.

Tell them you'd be happy to take care of those posts for them!

On our dirt road in MI there is a easment 24" on either side, starting at the road centerline. So there is about 12' from the road edge through the ditch onto my ground that the county has access to, there is the electric pole and phone lines within the easment.
Now I've did do something like this over 10 years ago. Our dirt road is about 2.7 miles long with 7 homes on it, it is mostly crops on both sides. There is a creek with bridge also along this road. About 12 years ago the county or state decided to replace the bridge and they did a great job, but they left all the signs and just laid them down flat. They stayed there for over two years, so the third summer me and my neighbor went and picked them up a used the angle iron and square tubing as we saw fit.
Hey every spring right before the free dump day,we are cleaning up trash from people dumping on our road, so it could be viewed as more dumping.

I would be surprised if anyone would give away the tposts,....especially over the phone.

Instead of asking if you can have them, ask them if they are coming back for them. That way, no one is on the spot. Once you get the answer you want, then stop asking anything.

Otherwise; Just take the things down, and use them how you want.

I agree, call and ask. It will take just a few minutes.

Wording is important. I'd be sure to say "Can I just clean up this mess, and get rid of it?" I'd be happy-go-lucky, and make a point of noting that you are happy to clean it up. You don't want to trigger them into driving out and doing it, as if it were a complaint.

Here is what NOT to say: "I saw that you left some nice T-Posts on my property, and I would like to use them."

My side of the fence, my posts... their side of the fence, their posts...

Oops, I own land on both sides of the fence... the county does not come down my road, I don't want em... my road is bumpety, raggedy, 'eye-teeth' jarring... just the way I like it.
