I need help to get a refund! Please help!

I am SO STUPID!! I never sign up for *free* offers and stuff because I always come out on the losing end. I know better. Really I do. But a couple weeks ago I ordered some of this stupid stuff and now I am really paying for it!

On the 19th of March I ordered a free trial offer of ColonCleanse. It said you have 15 days to try it for free. Well on the 3rd there was an $89.95 charge on my account (I check my checking EVERYDAY online). So I called and figured out what it was for and then called the company. I guess I was confused to start with because I thought I had 15 days to try the product, but they are saying I had 15 days COUNTING the day I placed my order! Now they have automatically charged me for a month supply since I didn't cancel in their time frame! I have emailed them several times and I will post that contact below. But I need help from some of you bright minds on a way to get a refund if possible. I can not afford to lose this money! Please help!

What makes all that worse it that is was a double deal with another product through a different company and I can't even talk to someone at the other company! The other one is charging me $87.13 and the only thing I have been able to do with it is talk to a computer and it says it is canceled but the charge is still there!

I am so so so very mad at myself right now for doing something this stupid. I just want to cry because I let myself do something as stupid as to lose 2 wks worth of grocery money for my family! Or that microwave we really need, or this or that or......URGH!! Have I mentioned how stupid I am?

I am completly humiliated and really didn't want to admit to anyone what I had done but I am coming to you guys in hopes you can help me. Please!

Emails go from latest received (this morning) to the first one I sent.

Dear Customer: Please see the terms and conditions below which you agreed to when you signed up for the trial sample with Max Colon: http://www.maxcolon.com/terms.html. Thank you, Anouk PCustomer

Dear Rochelle, Thank you for responding. I understand that the 15 days from the day I ordered was yesterday but I thought I had the 15 day supply to try it and see if it was something that worked for me. I didn't even have the time to see if it was a product that I liked since it took several days to get here. I understand what your stating it says as this is the same thing Fredrick H stated to me. I am also confused at to it was 15 days from the day I ordered I would think ordering late of the 19th the 1st day would be counted as the 20th which would mean today is 15 days. Please, I do not wish to have this product and do not have the money at all right now to pay for it. Please do what you can to help me in this situation. I really need help. Shawnna

Dear Customer,> > You received a charge of $89.95 because you did not cancel your account within the allowed 15 day trial period, as stated in our terms and conditions that you are required to read before purchasing. As stated in the terms and conditions, you have 15 days from your trial order to cancel or you will be sent another fresh 30 day supply of Max Colon for a total of $89.95. This is a continuity program for customers who like the product. Any customer who cancels within that 15 day period is removed from the continuity auto-shipment program and does not receive any further charges or shipments. Here is a direct link to our order page which contains the terms and conditions on the page above the Order button (http://www.maxcolon.com/terms.aspx). Please be advised that your order would not have been processed unless you agreed and accepted the terms and conditions.> > You were canceled so you will not receive any more products and will not incur any further charges from us.> > > > > Thank you,> > Rochelle> Customer Service

I am sorry I did not fully understand the 15 day trial period but I also have not even been able to take the product due to illness so I know nothing about it. I have no interest in paying for something like this and only signed up because of the free trial. At this time the $89.95 that I am being charged is 2 weeks worth of groceries for my family. I had no idea that this product could be charged to my account without any notification and now my account has been overdrawn. Please sir, I have no money to cover these charges. This is not a product I can use at this time. I really need a refund and will be more then happy to return the product when it gets here.> > > > Shawnna

Dear Customer,> > We have processed your request and your account has been canceled. Unfortunatley you had not canceled your membership within the 15 days from your initial sign up:> > > > You received a charge of $89.95 because you did not cancel your account within the allowed 15 day trial period, as stated in our terms and conditions that you are required to read before purchasing. My name is Shawnna. My billing zip is *****. I do not wish to receive your product but have received a charge on my credit card for your product (even though I have not received anything!). Please refund the amount of $89.95 that was charged to my account. Thank you.> > > > > > > > Shawnna

Call your credit card company and have them remove the charge. If they won't do it, ask to speak to a supervisor. If the supervisor refuses to remove the charge, tell him/her that if the charge isn't removed you will cancel the credit card.

Your only option might be to use the product and send them the results.

You can also contact the Better Business Bureau for the state the company is in, and also the Inspector General for that state. You can file a claim online with both places, usually. They helped me a few years ago when I ordered a new pump for our wading pool and the company charged me $100 for overnight shipping without asking me.

This sounds like sharp business practices to me: POSSIBLY not illegal but unethical.

Please call the CC company and challenge the charge. Explain that you think they are dealing in bad faith because you were not permiitted to take advantage of the free trial before you were billed.

The company will then have to argue about it with the CC company, and the CC company knows EXACTLY what they are doing! They will not be able to take advantage of the cc company!

You might not win this one, but I strongly suspect that you WILL win it, if you get the CC company involved. Mail order companies NEED the services of the cc companies! If you are angry, oh well. If the CC company decides to not do business with them, it will hurt them a lot.

Unfortunately, having read the terms, it *does* say that the 15 days includes shipping time. That stinks that they would do something like that, but you did agree to it. I'm afraid that you probably have no legal grounds because they did spell out the terms. I hope you get it cleared up, but I wouldn't be very optimistic. Best of luck!

Oh my gosh, I learned years ago to avoid those kind of offers, because they DO charge before you can stop it, and then you can't get it all straightened out.

If it's a monthly subscription, good luck stopping it!

Really sorry this happened to you. I noticed those guys awhile ago and studied up on them a little. They are scamming many many people. Exactly in the way you describe. Wishing you the best of luck getting your money back.

I think places like this are in business TO scam people. They make their money from their one-time sell.

I would report them to the BBB.

The terms shown are very clear. Sorry, but you don't have a leg to stand on, and if you try to reverse the charge, looks like you could get clipped for more money. Take it as a life lesson.

Do they offer a money back guarantee on their products? If so, GET A RETURN AUTHORIZATION and send it back. Then you'll only be out the shipping cost.

Shawna, call your credit card company immediately. I had a similar thing happen last week, where I was charged on my card for something I did not give them authorization to do. I called my company, they put the money back on my card, and started an investigation with the other people. Everything is on hold now until the cc company and the chargers come to an agreement. Do it quick!!! Marilyn

Call your CC company and see if there is anything they can do, and next time, don't set yourself up like this. If you have no intention of ordering the product after trial, don't sign up for the trial.

I have to agree... They make it very difficult to get any $$ back... I hope you get it worked out!

I find it kinda funny that you admitted to the company that you had no intention of buying their product, and were merely trying to get a freebie from them!

I've heard it's very hard to scam anyone who isn't greedy, or trying to get something for nothing. I tend to believe it ...

Just DON'T give out your credit card information online. Please don't. You have no idea who they will sell that info to. If a company is shady, everything about them could be shady.

I only deal with VERY secure transactions. A company offering 'free' stuff is often not that secure.

You tried to scam a scam and got caught. You had no intentions of buying their product. The terms are clearly laid out saying that you have 15 days from the day you ordered. Sorry, but I think you are out of luck.

I am not sure what to do about the double deal with the other company. You are probably stuck paying that too. And since they BOTH have your credit card info you might get stuck paying every month. They might say that you can only cancel over the phone, but maybe not have a phone number or something. They will have a way to get every penny out of you possible.

Companies that 'feel' like a scam rely almost solely on the fact that the average person will fail to read the fine print. I used to work for a SCARY credit card company in the collections department. The 'fine print' stuff will kill you. I had to quit that job because it was stealing my soul to work there. I dealt with case after case everyday where peoples lives were literally ruined because people had failed to read the fine print. It's really really sad.

This is different cause the poster DID authorize the future shipments Because of ordering said Free Offer~!!! Just hadn't read the fine print, but it IS there you must cancel within said date Or Else. And now we all know what that or else is, now don't we?
