Whos Fault Would It Be?

Ok I almost had a bad wreak yesterday.I was going down the highway,came up behind a County Truck with sign on back MOWERS AHEAD.It was stopped in the Highway on a hill.

I stop look around him can't see anything coming.So I give it gas and swing out to go around.Then I see a car coming,hit my brakes,couldn't pull back in without hitting the Truck,so I got close as I could along side him.And the car,just had room to squeeze by.

Thank the Lord we didn't hit.But I really don't feel it was my fault,if the Truck had been more on top the hill where a person could see on the other side would have been better.Maybe he figured people coming behind him could see since he could

What you Guys think on this? If your understanding the situation.

I think there should have been a flag person there if there was limited visibility of oncoming traffic.

Simply because you are in the other guy's lane, I think it would be your fault.

Glad the accident didn't happen.

It's your responsibility to safely pass. If they always park the truck on the top of the hill how does the top of the hill get mowed.

Maybe not your fault in a court. I don't know why, but I've seen this a lot. I have neighboring farmers that will park on top of a hill with a grain truck at harvest. The idea is that everyone can see their truck. Problem is : like big rockpile, a approching car can't see if there is any oncoming traffic and has no choice but to pull out and hope it is clear. In court, a case might be made for obstruction of traffic and creating a hazardous situation.

The Mowers were on down about a hundred yards on down the othere side of the hill.The Guy was just setting in the Truck.I really think they should have pulled the Truck off and had a Flag Man.Instead of having the Truck where you couldn't see.

Quite simply put, move the sign/truck back 250 feet. The warning can come well before the mowers! It was NOT your fault. There is no way to change the laws of physics to be able to "see through" the hill. That was a terrible place for the truck to be parked! I'd write down teh company name and complain. The safety issue is theirs because they created a hazard!

I agree, it's your responsibility to safely pass, in the eyes of the law. However I think the mowers/truck created a very dangerous situation, and I would contact the County Supervisor in charge of the mowing, to alert them of the danger they put you and others into. That could very easily have been an accident with at least 2 fatalities.

I'm glad you're ok.

Sounds like it was a dangerous situation and really the big truck caused the dangerous situation. BUT you was going around the truck when you couldnt see, so might be both your faults??? Glad you are ok.I also agree with the above post, ide call someone and complane.

The other day we was was driving along and there was a stop sign that most folks around here only yield to because its such a rural area... well none the less there was a stop sign and my husband just kinda glances and keeps going... NOT SEEING THE ONCOMING WHITE TRUCK HEADED TAWRDS THE PASSENGER DOOR. I was kinda panicked seeing this headed at me and kinda hollar at him to let him know. He slammed on the brakes jerking us forward and the truck swerves away and wellll I GET YELLED AT BECAUSE MY HEAD WAS IN THE WAY AND BLINDED HIM SO HE COULDNT SEE THE TRUCK COMING. but he only glanced and never came to a complete stop at the stop sign. But it was my fault, I guess i have a BIG head

It would have been your fault if there was an accident, but then again, it's Missouri with the hilly 2 lane blacktop. I would blame the county/state driver in the truck for not flagging you around. He may have been asleep if the mower was 100yds ahead of him.

Your fault.
Just have to wait till its safe to pass. yep you might have to wait a long time eventually he will move the truck or come ask why your not passing then ya tell him you cant see around him
And just for reference even if a flagger is there you are responcable for your safety
