Missouri Landlord and Tenent Law is simple......contract states the terms and that is what you go by....if you are 1 day late with the rent, landlord can void the contract.
Or month to month/verbal....meaning that landlord can raise your rent to whatever amount with a 30 day written notice or can terminate the agreement whenever they want for any or no reason with a 30 day written notice.....there is more, that is the basic.

I suspect that somewhere between the Tyranny of Big Government forcing the helpless property owner into renting his home to people he hates for a pittance while going bankrupt over maintenance costs and the Anarchy of the Evil Landlord charging his tenants so much that they must choose between food and the rat-hole they are living in there exists normal, sane, Representative Government, but I don't care enough to try to prove it to folks who disagree

I'm sure it is somewhere but as I have pointed out it isn't here in the US. Be nice if our government was sane enough to think we were smart enough to pick our own light bulbs, shower heads, toilets, what foods we want to eat, how said food is prepared and/or packaged and such. You know smart enough to handle freedom. Of course seeing as how the people are just sitting back watching it happen (and many of them don't care as long as it "works for them") the government may just be correct on the IQ of the populace and they needed to be treated like children/slaves.

Part of me hopes my days on this earth are fewer than I expect because its sad to watch this happen to the nation I used to know. I used to think there were more freedom loving people who were willing to try to stem the tide but I fear the few of us left have already been overwhelmed.

History would indicate the jury is still out on whether we are smart enough to do any of that. Not that I support government trying to do it, since a government is no smarter than the people in it.

You know Watcher I really disagree with a lot of what you have posted but I sure respect that you have been honest and forthright in saying what you have and this statement has me curious. I dont like where we are or heading either but what part of how it used to be do you miss? I am sincerely curious because in my own 51 years the good old days werent so good and life today for me personally is pretty happy and content even with the way things are going. Is there one thing or period that stands out for you or is it just your general feeling of disgust over the current government/society/??

As a general statement I miss the individual having control of their life and property in areas which only affect or endanger them. As I have said many times, the government's job is to protect the individual from harm from others and NOT to protect the individual from himself. An example we see here all the time, the government has decided its too dangerous for me to be able to buy raw milk so it passes laws making selling it illegal. Just where does the government get the right to tell the individual something is bad for them?

I miss people being HELD responsible for their own actions. Its not the mower maker's fault you lost body parts because you stuck your hand under a running lawn mower, its yours. Deal with it.

I miss schools which taught kids HOW to think instead of WHAT to think.

I miss King's dream where we were working for a time when you judged a man by the content of his character not the color of his skin. That dream is dead, buried and is being urinated on by people like J. Jackson, Sharpton and Obama. One of the proudest moments as a parent is when one of my kids came home saying the school was probably going to call me about a problem. They had refused to put their race on a form and when the teacher told them to they told the teacher "In our house we don't judge people by their color.". Teacher was a bit upset that a kid would stand up to her.

Bet that one surprises you, seeing as how I have said in this post a person should have the right be a bigot and not sell/rent/serve someone based on their skin color, religion or whatever.

I miss when wars were fought to win by the politicians saying "Cry Havoc! And slip the dogs of war" then mostly standing back until it was over.

I miss when teachers were allowed to discipline kids and the school system backed them up. When you let the punishment fit the offense, not a stupid "zero" tolerance policy where a 6 y.o. with a plastic knife in his lunch bag was treated the same way as an 18 y.o. caught with a handgun in his pocket.

As to where we are heading as a nation. I hate the fact we are heading more and more to a nanny system. Need food. . .government will give you some. Need housing. . .government will give you some. Need medical care. . .government will give you some. You are clearly too stupid to know you should use a low flow toilet. . .government will force you to buy one. Too stupid to to realize you are using the wrong light bulb. . .the government will forbid you to buy them. Too stupid to wear a seat belt. . .the government will force you. Too stupid to realize raw milk will kill you. . .the government will stop you from buying it. So stupid you stuck your hand under a running lawn mower. . .government will let you sue mower maker AND force them to build mowers which will stop other stupid people from doing it.

To put it in a nutshell I morn the loss of the individual's freedom.

I won't even get into where society is going.

Now am I saying things were peachy king back in the good days? Of course not. But for the most part we were heading in the right direction back then.

I appreciate your response Watcher as it gives me a little better understanding of what you post sometimes and I actually feel the same way in a lot of what you just wrote. My own childhood in the 60s and early 70s was less than ideal so I dont have any great memories of how things used to be but I moved where I am at now precisely because I was seeking some of those things you mentioned. We have no building codes or zoning, little government interference (at the local level), raw milk is available if you want it, etc. So I guess you yearn for the good old days you remember and I yearn for the good old days never experienced but at least for me I have found the closest I can get and am pretty content. No prob. But you should remember, when even a few American's lose a freedom it places all of our freedoms in danger.

Look at the example in this post. People have no problem with the government telling someone who he must rent/sell to, no problem with the government telling someone how he may adjust his prices. They don't stop to think if the government has this power what is to stop it from telling someone how much they must charge to rent/sell their property for? How would they like it if the government came in and told them they could not charge $200,000 for their house they could only charge $100,000? The odds are they would start screaming "That's not fair its MY house I should be able to set what ever price I want!!!".

I have no problem with the govt enforcing the law which requires a landlord to hold to a written contract. Big difference between that and telling him what he is allowed to charge for rent.

As stated one of the government's duties is enforcing contracts but the problem here is if there is no contract the government forces the property owner to do something he may or may not wish to do.

He wants to raise the rent because the value of his property has skyrocketed, simply supply and demand. If there are written contracts which state the amount of warning before a rent increase goes into effect then I have no problem. But if there is no contract I have a HUGE problem with the government telling him what he is not allowed to do with his personal property as he wishes. It is doing this when it tells him even though there is no contract he must wait X number of days before he can change the rent.

By contract law in regards to housing if there is no signed contract there is an understood month to month tenancy agreement. This clause is in every single rental contract I have ever seen and is a standard legal premise. Even if it was not the landlord is not allowed to raise the rent in the middle of the month in a month for which rent has already been paid.

The lawsuit basis was on the fact that the apartments were already rented and under contract either written or understood and the landlord attempted to modify the agreements in an illegal manner.

He thought these people were good enough to rent to before the tornado. Their money was good enough before the tornado. Tenant right laws do not prevent him from raising rates after the contract expirations. So I don't see how you can be in such a huff about the govt requiring this scumbag to uphold his end of those contracts already in effect. The law is not preventing him from raising his rent, it is requiring him to uphold his end of the contracts.

If he doesn't like the month to month agreements he should require all tenants to sign new one year leases at least 30 days prior to the expiration of the old leases. That is his right and his choice.
