Most guns are given away to family members or friends before a death. I recall an anti gun researcher who said that ther were not many guns around during the colonial days and used the records in the probate courts as proof. Another researcher said most guns were given away as the owner aged or had ill health. Guns that were known to be owned by Thomas Jefferson did not appear in the probate records. They were given away before he died.

The only guns that are subject to Federal law are Class 3 weapons. Those can be inherited by immediate family members without having to go through the normal process. However one still has to file paperwork showing the transfer of ownership, and provide copies of the paperwork where the decent paid the transfer tax on the weapon.
